Are you properly licensed for the work you’re actually doing?

It sounds basic, but licensing issues can have serious consequences for contractors and subcontractors in Queensland.

Under the QBCC Act, carrying out work without the required licence or an effective exemption, has serious consequences. It will impact your entitlement to payment and your ability rely on subcontractor charges and other BIF Act enforcement to recover payment.

There are exemptions in certain circumstances, including the head contractor licensing exemption, but whether an exemption applies will depend on the work being performed and how the project is structured.

Before signing a contract, expanding your scope or taking on a different class of work, it is worth obtaining advice on exemptions in play and your obligation to put parties on notice regarding the engagment of licensed subcontractors.

The Tigers took on Wynnum Manly at BMD Kougari Oval with a place in finals week on the line, and they got the job done.
Special mention to the BMD Cup girls who ran riot over Wynnum Manly with a 46 - 0 victory!

Congratulations to the players, coaching staff and everyone behind the scenes on earning the opportunity to keep the season going. A great result for the club and a testament to the work that has gone in throughout the year.

When Contract Preconditions to Payment Are Ineffective 🟠

A clause being written into a construction contract does not necessarily mean it can be relied upon to withhold payment.

In Alstef Aust. Pty Ltd v Brisbane Airport Corporation [2026] NSWSC 74, the NSW Supreme Court considered a contractual requirement for the contractor to provide security bonds before becoming entitled to payment for unfixed goods and materials.

The Court found the relevant clause was void under s200 of the QLD BIF Act, as it operated to exclude the contractor's statutory right to progress payments unless the additional security was provided.

This decision has important implications for QLD and NSW construction projects, particularly where standard form or amended contracts contain similar security requirements or other preconditions to payment.

The key takeaway is that contractual preconditions to payment need to be considered against the anti- contracting out laws in SOP legislation before relying on them in a payment schedule or in a dispute.

What a fantastic afternoon of rugby league at Totally Workwear Stadium over the weekend.

Practical tips for BIF Act payment claims - identify the work performed for each claim item.

When preparing a BIF Act payment claim, it is not enough to list an amount claimed by reference to percentage complete against a trade breakdown or services package. The actual work performed since the last claim should also be briefly described to ensure the claim is valid. Where it concerns provisional sum adjustments and contract price adjustments, detailed adjustment calculations are needed

A valid BIF Act payment claim must specify:

⚪ What work has been performed - by more than % complete for each claim item
⚪ What amount is being claimed for that claim item
⚪ How the amount claimed for each item is calculated by reference to supporting records or documents.

High-level descriptions and percentages must be supported with brief summary details of the work and detailed calculations of the value in supporting documents.

Contractors, subcontractors and consultants be aware - BIF Act claim preparation is not just an administrative step, it is a critical step to preserving your fast-track BIF Act payment rights.

Contractors and subcontractors should use the start of the new financial year to formally finalise past construction contracts, where security or retentions remain outstanding and the issue of completion unresolved.

As projects move into a new financial year, finalising contractual obligations and exchanging releases may be an effective way to end the relationship. Leaving matters such as practical completion and retentions unresolved, can expose contractors to ongoing liquidated damages (LD's) claims when contracts are left hanging.

For contractors, subcontractors in particular, now is the time to:

⚪ Agree terms for contract completion and outstanding claims,
including resolution of defects; and
⚪ Recover any security and end the contractual realtionship.

Taking a proactive approach in these matters will limit your exposure to liquidated damages and other claims moving forward.
