Are you properly licensed for the work you’re actually doing?
It sounds basic, but licensing issues can have serious consequences for contractors and subcontractors in Queensland.
Under the QBCC Act, carrying out work without the required licence or an effective exemption, has serious consequences. It will impact your entitlement to payment and your ability rely on subcontractor charges and other BIF Act enforcement to recover payment.
There are exemptions in certain circumstances, including the head contractor licensing exemption, but whether an exemption applies will depend on the work being performed and how the project is structured.
Before signing a contract, expanding your scope or taking on a different class of work, it is worth obtaining advice on exemptions in play and your obligation to put parties on notice regarding the engagment of licensed subcontractors.
