Welcome news for both Australia & India 🇮🇳

The Free Trade Agreement Australia had signed with India on the 2nd of April, 2022 has some great visa opportunities such as:
✅ a ‘backpacker visa’ also known as a Working Holiday visa will be implemented within the next two years and will allow up to 1,000 people annually to participate
✅ also eligible Indian students can stay longer in Australia
✅ Indian IT professionals and managers can also get up to four-year visas & mutual recognition agreements for professionals which includes nurses and doctors.

Details are said to be finalized within the next 12 months. 🗓

Minister for Trade, Tourism and Investment Dan Tehan has said, “The Australia-India agreement would create new opportunities for jobs and businesses in both countries.”

***Age Limit Removed For ‘Legacy” 457 Visa Workers***

So, what exactly qualifies as a ‘legacy 457 visa worker’?

A legacy 457 worker is a subclass 457 visa holder who was not able to take advantage of the 2018 transitional arrangements.

Previously, subclass 457 visa holders who were:
➡️ 50 years old or older at time of application for their subclass 186 visa (or subclass 187 visa),
➡️ or applied for their subclass 457 visa on or after 18 April 2017 (legacy 457 workers),
were not able to access transitional arrangements.

Transitional arrangements were made for existing subclass 457 visa holders and applicants to continue to access permanent residence through a subclass 186 visa or subclass 187 visa. Unfortunately, there was an age limit that some previous 457 visa holders had reached. That age limit has now been removed.

***Vietnam joins the Australian Agriculture Visa Program***

On the 28th of March 2022, Vietnam 🇻🇳 had become the first country to participate in this program. In summary, Australia’s Department of Foreign Affairs and Trade will work be working with approved employers in Australia to support Australia’s labour supply with Vietnamese workers.

“For decades, Vietnamese workers, students, businesspeople, and tourists have made extensive contributions to Australia.”

Under the Australian Agriculture Visa program, employees will be recruited to work across a range of agriculture sectors, including:
✔️ horticulture,
✔️ dairy
✔️ wool
✔️ grains
✔️ fisheries and forestry including support services

A huge help to Australia with great opportunities, a win for all involved.

***Migration Planning Levels announced for 2022 & 2033***

Higher allocation levels for the Skilled Stream is always welcome news!

Announced on the 29th of March 2022, the Australian Government will reinstate Migration Program planning levels to 160,000 in 2022-23. With the Skilled Visa Program getting an increase of 30,000 places over the 2021-22 allocated numbers and will account for 70% of that amount with a total of 109,900 places.

Other:
✅ Family visa allocation will allocated the remaining 30% of places within the program. Parent visas have received only a small increase in allocation due to the decline in on hand Partner visa applications
✅ The Humanitarian Program will be maintained at 13,750 places in 2022-23 with 4,000 three year Temporary Humanitarian Concern Visas (Subclass 786) to Ukrainians
✅ WHM places will increase by 11,000 (and extra 30%) in 2022-23 & WHM visa holders who arrive in Australia between the 19th of January 2022 and the 19th April 2022 will be eligible for a refund of their application fee.

Recently announced was that:
✔️ the age limit for Italian and Danish citizens wanting to work and travel in Australia will be increased from 30 to 35 years of age starting the 1st of July 2022
✔️ new reciprocal work and holiday visa arrangement which will allow young people from Brazil to work study and holiday in Australia

Recently an article by Australian Financial Times had pointed out that “…a critical shortage of engineers threatens to cripple economic expansion.”

A report by Group of Eight (Go8) in December 2021 argues that “...only half the estimated 11,000 new engineers who will be needed each year over the next five years are now graduating from universities.”

👉 A reminder that engineers are in high demand in Australia and hold 8 of only 44 professions on the on the Priority Skilled Migration List (PMSOL) which is to fill critical skills needs to support Australia’s economic recovery from COVID-19.

DID YOU KNOW🤔 Skilled Migration state and territory allocation numbers are reset every July due to the new financial year in Australia?

Why this is important…

Although Australia’s economy has bounced back and unemployment is at record lows — there is a very big skill shortage. Australia historically is a migrant country and has one of the highest immigration rates in the world with the highest proportion amongst Western nations.

As we’ve mentioned before, if you are thinking of doing a skilled visa it is best to be document ready.

Skilled visas such as 189, 190 & 491’s to name a few require similar documents, which often take weeks to (sometimes) even months to acquire. Your visa application may be delayed or refused without them!

Typically the most common required documents are:
✅ Passport & Identity documents of yourself, partner and your dependants
✅ English language test results
✅ Proof of of Education qualifications
✅ Employment contracts and or tax documents & payslips
✅ Skills assessment documents
✅ Police clearance certificates from from your home country & where you spent a total of 12 months or more in the last 10 years since you turned 16. If you are onshore this would include one from Australia as well.

There are many things we can’t control in migration but this is the part that is in your hands if you are considering applying for any of these visas.

***Pandemic Event Visa Update***

The 408 Visa was previously a new Temporary Activity visa that prolonged your stay in Australia from 3 months to up to 12 months by allowing a visa holder to work in a critical sector and/or to remain legally onshore whilst awaiting leaving Australia. 🇦🇺

However, recently, it has become more flexible in that a temporary resident onshore may be able to prolong their stay in they are working to boost Australia’s economy in any sector.

This is great news for temporary residents who are onshore and are contributing to the economy and would like to stay longer whilst doing so.

“There are more jobs now available in Australia than before the COVID-19 pandemic, and businesses across all sectors of our economy are crying out for skilled workers to fill vital roles,” Immigration Minister Alex Hawke has said.

***Permanent Residence Programs for Onshore Hong Kong Residents***

With changes having commenced from the 5th of March, 2022, Australia also launched two permanent residence pathways for 🇭🇰 Hong Kong nationals:

✅ Subclass 191 Program - for HKSAR/BNO passport holders who have resided in Australia for a continuous period of at least three years and who have lived, worked, and studied exclusively in a designated regional area for that period
✅ For HKSAR/BNO passport holders who have stayed in Australia for a period of at least four years while holding a qualifying subclass of visa such as 457, 482, or 485 & holding that same visa for the whole duration of the 4 years

Please pass along to anyone you know this may be of interest to. It is estimated that there may be up to 9,000 Hong Kongers who would be eligible.

The Australian Government has made an arrangement with ACECQA (Australia Children’s Education & Care Quality Authority) to provide FREE and fast-tracked assessments to skilled migrants ONSHORE.

Some eligibility requirements:
➡️ be currently residing in Australia
be in Australia on an eligible visa (please refer to the list of eligible visa sub-classes below), that was granted on, or after, 1 January 2019
➡️ be applying for a visa relevant to this skilled occupation & applying for assessment against the Standards for the Child Care Worker (group leaders only) (ANZSCO Code 421111) occupation

***Subclass 489, 491 & 494 Holders Past & Present May Qualify for Visa Extensions of 3 Years***

The Australian Government will extend by 3 years Skilled Regional Provisional (subclass 489, 491 and 494) visas where the visa holder was impacted by COVID-19 international travel restrictions. This is especially great news for Subclass 491 and Subclass 494 as the extension will help them meet permanent residency requirements.

Details:
✅ Subclass 489 Primary applicants must have been offshore Australia at any time between Feb. 1, 2020, and Dec. 14, 2021; must have held or still hold a subclass 489 visa and not have had their subclass 489 visa canceled.
✅ Subclass 491 and Subclass 494 Primary applicants must have been offshore Australia at any time between Feb. 1, 2020, and Dec. 14, 2021; must have held a subclass 491 or 494 visa during that time and still hold validity as of Feb. 18 and not have had  their subclass 491 or 494 visa canceled.
