Are you considering making a will? In the case of Girotto v Girotto [2025] NSWSC 616 the Supreme Court of NSW deemed that the son of the testatrix (deceased) did not receive an adequate provision from his mother from her estate. The court considered their relationship, the size of the estate and the provision made to her other son and beneficiary. To ensure you leave an adequate provision to your beneficiaries and eligible persons, and to reduce the possibility of your beneficiaries having to endure contested proceedings in respect of your estate following your death, feel free to contact RCW Law to help you to obtain advice from Rebecca and to prepare your will.
