Thinking about a Binding Financial Agreement?

Binding Financial Agreements (BFAs) aren’t just for couples preparing to get married. They can also be entered into during a marriage or de facto relationship, or after a relationship has ended.

A BFA can help couples make arrangements about their property, finances and other financial interests, but there are important legal requirements to consider before signing.

Our Family Law team has put together 5 things you should know about BFAs, including what they can cover, why independent legal advice is required, and the circumstances in which an agreement may be challenged.

👉 Swipe through for some practical guidance from Rebecca Wilson and Mikaela Egan.

If you’re considering a BFA, Rebecca and Mikaela can help you understand your options and the legal requirements involved.

Choosing the right executor is an important part of planning your estate. 🏡

Your executor is responsible for administering your estate and ensuring your wishes are carried out after you pass away.

While it can be tempting to choose someone simply because they’re family or someone you’re close to, it’s important to consider whether they have the time, ability and willingness to take on the responsibility.

Our Wills & Estates lawyer, Tammy Dickson, shares some key qualities to look for when choosing your executor.

⚖️ Received a Statutory Demand? The clock is ticking.

For company directors, receiving a statutory demand is something that should never be ignored.

A statutory demand is more than an ordinary debt collection letter. It is a formal legal process under the Corporations Act 2001 (Cth), and failing to respond appropriately can have serious consequences for your company.

⏰ You generally have just 21 days from the date of service to act.

If your company fails to comply with a statutory demand or take the necessary steps to challenge it, the creditor may be able to rely on a presumption of insolvency and commence proceedings to wind up your company.

But receiving a statutory demand doesn’t necessarily mean the debt is undisputed or that you have no options.

Depending on the circumstances, there may be grounds to apply to have the demand set aside, including:

🔹 A genuine dispute about the existence or amount of the debt.

🔹 An offsetting claim against the creditor.

🔹 A defect in the demand that causes substantial injustice.

🔹 Another sufficient reason for setting the demand aside.

Importantly, an application to set aside a statutory demand, together with the supporting affidavit, must be filed with the Court and served on the creditor within the strict 21-day period. Negotiations alone do not stop the clock.

👩🏻‍⚖️ Our Associate Lawyer, Sammy Brown, explains what company directors need to know about statutory demands and why obtaining legal advice early is so important.

Whether your company has received a statutory demand or you are considering issuing one to recover a debt, our Civil Litigation team can help you understand your rights, obligations and available options.

We absolutely love receiving feedback like this. 💙

Wendy has been a client of Griffiths Parry since 2013, and over the years we’ve had the pleasure of assisting her with building a home in Caloundra, selling that property, purchasing another property in Townsville, and her estate planning.

In her recent feedback, Wendy had some particularly lovely words for our Conveyancer, Michelle Schneider, describing Michelle as always being quick to respond and pleasant to communicate with. She also gave us a 5/5 overall satisfaction rating and 10/10 for recommending GP Law to others.

Buying or selling a home can involve a lot of moving parts, and having someone who keeps you informed, responds when you need them and takes care of the details can make the whole process a lot easier.

Michelle brings exactly that approach to her conveyancing work, and we’re very lucky to have her looking after our clients.

Thank you, Wendy, for trusting us over so many years, and for taking the time to share such lovely feedback.

If you’re buying or selling and would like professional, thorough advice and assistance delivered with care, contact Michelle and our Property team.

If you operate a management rights business, you’ve probably heard plenty of talk about “topping up” your agreements.

A top-up involves varying your management rights agreements to add further term. Depending on the regulation module applying to your scheme, the maximum total term is generally 10 years under the Standard Module and 25 years under the Accommodation Module.

What is sometimes overlooked is that a top-up is not automatic. It requires the approval of the Body Corporate, and lot owners can vote against the proposed variation.

It is also different from exercising an option that is already contained in your agreements. Existing options need to be exercised in accordance with the agreement and within the required timeframe. A top-up involves adding a new option to extend the remaining term.

Keeping track of these dates is particularly important if you are thinking about selling or refinancing your management rights business. Finding out that an option date has been missed, or that there is less term remaining than expected, is not something you want to discover halfway through a transaction.

Our Director, Paul Davis, and Senior Associate, Kara Lawson, regularly work with management rights operators on top-ups, variations and agreement reviews.

If you’re not sure how much term you have remaining, when your next option needs to be exercised or what is involved in seeking a top-up, Paul and Kara can help you work through it.
