Significant ART Outcome: Overcoming Character Refusal for Australian Citizenship 🇦🇺
We are pleased to announce a successful result at the Administrative Review Tribunal (ART) regarding a complex citizenship matter.
Our client’s application for Australian citizenship was initially refused due to a serious offence that occurred in the past. Despite nearly 17 years of living a productive life and raising a family in Australia, the Department was not satisfied he met the 'good character' requirement under s 21(2)(h) of the Australian Citizenship Act 2007.
We challenged this decision at the Tribunal, presenting a robust case focused on our client’s total transformation and "enduring moral qualities".
The Result: The Tribunal found that while the past offence was indeed serious, our client’s conduct over the last 17 years—including his professional reliability and community contributions—demonstrated that he is now a person of good character. The Tribunal set aside the original refusal and remitted the matter for reconsideration with the order that he satisfies the character requirements.
