The Federal Budget 2026-27 proposed 30% minimum tax on discretionary trusts is not yet law, but it has already raised important estate planning questions.

In our latest insight, we explain why testamentary discretionary trusts (TDTs) are different from the more commonly used discretionary family trusts, how TDTs help protect inheritances, and why careful estate planning still matters. Hint: despite the potential tax on TDTs, they remain a legitimate succession planning tool.

Check out our latest insight on our website.

The 2026–27 Federal Budget included a proposal to introduce a 30% minimum tax on discretionary trusts from 1 July 2028. This article explains why testamentary discretionary trusts are different from family trusts, how they help protect inheritances for everyday Australians and their families, and ...

What happens if one day you cannot make decisions or speak for yourself?

That is where two key estate planning documents can make a real difference:

An Enduring Power of Attorney (EPOA), lets someone you trust make financial and/or personal (including health) decisions for you. This can be especially important if you are travelling overseas, unexpectedly become unwell, or simply cannot be contacted when an urgent decision needs to be made.

An Advance Health Directive (AHD), sets out your wishes for future medical treatment and helps guide your loved ones and treating doctors if you cannot communicate them yourself.

Having these documents in place can provide clarity, reduce stress, and make a difficult situation easier for the people closest to you. They are valuable assets that form part of a considered estate plan.

Do not leave things to chance. Plan well. Protect what matters. LLG can help.

Life moves fast. A new relationship, children, separation, or buying property can quickly make your estate plan outdated.

Many people treat their will like a one-time task – sign it, file it, and forget it. But this can be risky.

Imagine your old will doesn't reflect your current situation. It might leave your assets exposed or cause unintended disputes.

Estate planning isn't just about dividing assets after you're gone. It's about control and protection while you're still here.

Review your documents whenever your life changes, but at a minimum, we recommend every 2-3 years. That way, you keep your plans relevant and avoid unnecessary complications later.

If you're unsure whether your estate plan needs updating, ask these questions: Has your family situation changed? Have you acquired new assets? Have your relationships or responsibilities shifted? Do you have binding death benefit nominations in place for your Super?

Don't leave your future to chance. Keeping your estate planning documents current means by planning well now, you're protecting what matters most.

Got questions or need a review? We can help.

What exactly is a will, an Enduring Power of Attorney (EPOA), and an Advanced Health Directive (AHD) and what does each do?

Here's the lowdown in very simple terms.

> An EPOA is applies while you are still alive. It lets someone you trust make financial and personal decisions on your behalf. You can choose when you want the financial power to start, but the power over your personal (including health) affairs, only comes into effect if you have impaired capacity.

> An AHD applies while you are still alive. It records your medical treatment wishes in advance. It can include directions about blood transfusions, medical treatment options, and end-of-life care.

> A will applies once you have passed away. It sets out who your executor is (the person responsible for administering your estate), how your assets get distributed, and who looks after your kids. In more complex wills, it can also contain a testamentary discretionary trust that provides particular asset protection, taxation, and generational wealth benefits.

If you're in Queensland and want clear, no-fuss estate planning, it's worth getting these documents right. LLG can help.

A DIY will might seem simple now, but will it hold up when your family truly needs it?

Many people opt for DIY wills thinking it's a quick fix. They tick the box and move on, unaware that the real test comes later — when emotions are high and clarity is crucial.

A poorly drafted will can cause delays, disputes, and unexpected legal costs. For example, families have faced lengthy probate battles and confusion over asset distribution because the DIY approach missed key clauses or failed to comply with Queensland laws.

The takeaway? Estate planning isn't just about the document you create. It's about protecting your family's future and relationships when it matters most.

If you're serious about securing peace of mind, getting professional advice isn't optional — it's necessary. Don't leave your loved ones to untangle a legal mess during their most vulnerable time.

Thinking of a DIY will in Queensland? Think twice.

Making a will isn't simply about filling in the blanks. When a will isn’t done properly, the people you care about can be left dealing with confusion, delay, legal costs, and family tension.

Estate planning is more than just having a will. It includes strategic planning of your super, tax, and appointing financial and personal attorneys who can represent your interests when you cannot.

Doing it right today, means less risk (and cost) later.
