💻 AI has and will continue to change the family law landscape.
Increasingly, I am meeting with clients who have sought guidance from AI to help them understand legal concepts, their rights and responsibilities, help them draft messages, prepare questions and explore their options.
The tool can be beneficial for persons seeking information in a cost effective manner. However, it should not be taken as legal advice due to extensive variables within each family and case scenario.
⚠️ AI also generally tends to "agree" to the person making the prompt so there is a risk there of AI telling a person what they want to hear rather than unbiased information.
My role of a mediator is to faciliate conversations between participants with the goal of achieving agreements relating to their co-parenting arrangements and/or financial and property interests.
💔 Importantly, mediations dealing with family law are, by nature, attract raw human emotions as the participants are negotiating separation and planning for the care of their children and/or their property interests.
During the mediation process, we ensure that we are aware of the background information, perspectives of each participant and their priorities as well as understand the dynamic between the participants. This is to aid us while we ensure that both party continues to feel safe and heard and to ensure that any agreements are not coerced or unreasonably obtained.
By creating a safe space to discuss disputes and issues, we encourage discussion on options and obstacles and reality check scenarios so that participants understand what arrangements will actually look like in the real world. This often assists in encouraging the parties to towards interest based negotiation.
Not only does this assist with reaching agreements, it can also improve communication channels between the participants, particularly where co-parenting requires ongoing child-focused contact.
❤️ AI is a fantastic tool to assist in gaining knowledge. Mediators can assist to resolve the human disputes by bringing the human authenticity into the room.
