CHILD VISA (SUBCLASS 101) GRANTED – AN ADULT CHILD WITH THREE UNIVERSITY DEGREES

Who would have thought that someone holding three university degrees could still qualify for a Child visa?

We recently secured a subclass 101 Child visa grant for an adult applicant with three university degrees.

This was certainly not your ordinary Child visa application.

One of the challenges in dealing with adult Child visa applications is establishing that the applicant meets the dependency requirements under migration law. Having university qualifications does not automatically disqualify someone, but it certainly raises questions that need to be carefully addressed.

The case required us to reexamine the applicant’s circumstances, assess the relevant legal requirements and prepare the evidence accordingly as this was a file transferred from another law firm.

The visa was granted today after 8 months responding to multiple requests by the Department of Immigration.

After 16 years practising immigration law, I have learnt that the difficult cases are rarely resolved by simply completing forms and uploading documents.

It is about understanding the law, identifying the issues and knowing what evidence is needed to address them.

Another complex matter successfully concluded.

2021 → 2026. 482 → Permanent Residency.

This client from Melbourne first came to us during COVID for a 482 visa.

It wasn't an easy one. We had trouble getting financial documents from the sponsor; the occupation was one many migration agents/lawyers avoided, and at the time, there was no PR pathway for him 5 years ago because legislation prevented his occupation from being eligible for PR. We took it on anyway.

We got the 482 approved during lockdown, and stayed with him over the years.

Fast forward to 2025. His circumstances had changed, including health complications involving his child. We looked at the whole picture, planned the next move carefully and strategically lodged his 186 pathway to permanent residency.

**PR Granted today.**

Nomination approved. Visa approved. No further information requested.

Five years is a long journey. Our client trusted us when there was no guarantee of PR and stayed loyal to us from Melbourne all these years. We have never met once in the past 5 years, always communicating on the phone.

Good migration work is not always about finding the easiest visa today. Sometimes it is about knowing how to get the client to where they need to be five years from now.

Sometimes, a bottle of w**e tells a much bigger story. 🍷

I first met this client in 2022.His visa status was complicated. Before I could even advise him properly, I had to research the legal issues, retrieve historical records and piece together exactly what had happened before developing a strategy.

It wasn’t an easy journey.Along the way, I was probably abrupt with them more than once. But they trusted the process and, importantly, they never gave up on me.

Then came this client’s partner visa within a short time period.

The Department interviewed him, and there were inconsistencies in some of his answers. An interview like that can seriously change the direction of a case.

We dealt with the issues head-on. Seven days after the interview, his partner visa was granted offshore.

Today, he and his wife came to see me with their beautiful two-year-old daughter and brought me this bottle of Penfolds as a thank you.

Standing there looking at this little family reminded me of something important. I don’t need to fight every accusation, every rumour or every person who wants to question my professional ethics from the sidelines.

The fights worth having are the ones I undertake for my clients.My clients know how I work. They know I can be demanding, direct and sometimes abrupt. But they also know that when I accept their case, I take their problems seriously.
