Things can feel like a horror movie for your loved ones if you don't have a valid Will when you pass away.

If you think you have a valid Will but then you:

❌ got married; or
❌ got divorced,

guess again. You need to make like a pygmy hippo and Moo Deng your way to making a new Will 🦛

Consequences of not having a valid Will in place:

🥱 the government's estate plan for who gets your assets (and how much) kick in by default;
🥱 the people you actually want to benefit from your assets receive less or even nothing;
🥱 the death admin involved in sorting out your affairs can be more complicated and costly (compared to if you had a valid Will in place).

Pasta la vista, baby 😎

Saying good bye to a loved one is never easy. Dealing with what happens after they pass away might not be easy either:
✅ arranging the funeral
✅ finding the Will and applying for probate
✅ *OR* not finding the Will after flipping the house upside down and applying for letters of administration
✅ collecting the assets and paying the debts
✅ complying with tax and legal requirements
✅ distributing the estate to the beneficiaries

Bring on the gin, you've got an extra ring! 🥃💍

You're legally married now. Great, but what's next? Setting aside the usual "so when are you having kids?" from the parents and aunt Gladys, you and your paramore are now in a limbo where you're now unprotected.

Unprotected from what? From having your written wishes in your Will being upheld if you passed away.

Wills are not a set-and-forget thing. If you made a Will (hurrah for you) but then got married afterwards, the Will is no longer legally valid**

Which is why as soon as you sign your marriage certificate you NEED to sign your new Will as well! 💒✍️💕

We all know that bullying is never okay. But there's one exception: BULLYING INTESTACY 💥☠️

What does intestacy mean, you ask? It's when someone passes away without having a will in place! 📑🚫

When it comes to intestacy, we should become fierce bullies. Intestacy causes confusion for loved ones, stonewalling from banks, the ATO and other financial institutions, and increases fees and costs to handle the deceased's affairs 👀

Let's unite, write our wills and bully intestacy into oblivion!! Together, we can be the bullies that intestacy never saw coming. Let's spread hope and fight against this dastardly foe named INTESTACY 🌈❤️

Life can take unexpected turns, and we've got to be prepared for whatever may come our way. 🔄 That's why I've taken an important step in securing my future - crafting an enduring power of attorney and enduring power of guardianship! 📝💪

🌟 What's an enduring power of attorney, you ask? It's a legal document that allows me to appoint someone I trust to make financial decisions on my behalf and look after my money/assets if I ever become unable to do so myself. It's like having a trusted ally in my corner! 🤝✨

🌟 What's an enduring power of guardianship? It's a legal document that allows me to appoint someone I trust to make health decisions for me and safeguard my body if I can't make those decisions myself. You too can have your own guardian angel with an enduring power of guardianship! 👼✨

✨ So why are they important? Well, it's a way to ensure only someone I trust will manage my life and assets if I ever become incapable. It's like having a safety net to avoid the Public Trustee or Public Advocate, a complete stranger who doesn't know or care about me, making those kinds of decisions for me. 🚫🧐

When someone you know (and / or love) dies it can be a difficult and overwhelming time. We've been there and we can relate. But here are some steps you can take especially if you're that person's executor or next of kin:

💚 Take care of yourself. Grieving is natural so it's important to take care of yourself during this time. If not for yourself, but for your fave people around you. Get support from your family and friends and consider chatting with a therapist if you're not coping well.

💚 Make funeral arrangements. Decide whether the deceased will be buried or cremated (perhaps they told you how they wanted to go, or perhaps their funeral wishes are written in their will), and plan the funeral service (perhaps with the help of a funeral director). Start to let the deceased's family and friends know of their passing - over the phone, in person or via social media will do it.

💚 Find the will because it will be the source of the executor's power to handle the deceased's affairs and contain the deceased's wishes.

💚 If you're the executor or next of kin (if there is no will), you will need to identify what assets and debts the deceased had in order to settle their debts and distribute the deceased's assets as per their will (or the distributions set out by law if there is no will). Hopefully the deceased made things easy for you and kept good records of everything 🤞

By making a will, you can ensure that only the people you like will be entitled to your assets after you die. You can also make sure that only the people you trust will have the care of your children if both you and your co-parent die.
