Our clients, both past and present, along with members of the community who are familiar with the area, will be aware of the old church building at the front of the property where the firm is situated. With the front of the church building facing Angle Vale Road, hundreds of cars drive past the building every day — but how many know the history of the building and how it came to be?

Built in 1854 and opening for Sunday service on 10 September of that year, the church was built by Samuel Keen of the Bible Christian Church, a small Methodist denomination. Being built in 1854, the church building is one of the oldest in South Australia.

The church was named ‘Ebenezer Bible Christian Church’, with ‘Ebenezer’ being a Hebrew word for “rock (or stone) of help.” Ebenezer was also the name of the region until mail services were introduced around 1866, with it being called ‘Angle Vale’ thereafter.

Interestingly, a preacher within the church, Reverend James Way, was the father of former Chief Justice of the Supreme Court of South Australia, Sir Samuel Way. This is an interesting parallel, given the land is now host to our firm.

The firm operates out of the newer hall, which was constructed and opened in 1924, with the foundation stone being laid by Mr. A. E. Rowland (as pictured below).

It is a privilege to be able to work within such a remarkable building, on premises that were in use before Angle Vale even existed.

Why is it so important to have a will in place?

This is such an important question, and there are many possible ways to answer it. One of the most fundamental reasons for having a will is that it allows you to appoint someone as the executor and trustee of your estate in the event of your passing.

A key reason why this arrangement should be in place is that the absence of an appointed executor and trustee may result in the Public Trustee (government) assuming the role. This is particularly common in situations where there are minor children (under 18) set to receive an inheritance from the estate, but the other parent has already passed away.

The Public Trustee acting as executor and trustee of an estate can be problematic, as the associated fees are significant — with a charge of 4.4 cents out of every dollar up to $200,000. This means that estates valued over $200,000 — which includes most — will have to reimburse the Public Trustee an amount exceeding $8,800.

Having proper wills in place could potentially cost significantly less in the long run, leaving a greater amount left over for your loved ones.

What is a Caveat?

A caveat on a property is a formal warning or notice that informs the public, particularly prospective buyers, that someone has a legal interest or claim on that property.

It essentially acts as a "freeze" on the property, preventing the registered proprietor from transferring or registering dealings (like a new mortgage or sale) that might conflict with the caveator's interest.

A caveat gives notice to everyone that there's a potential issue or claim regarding the property's title.

It protects the caveator's interest in the property, preventing dealings that could jeopardize it.

Caveats are often lodged to preserve the status quo when parties are in dispute about the property, allowing time for resolution.
