FROM BUSINESS DISPUTE TO CRIMINAL ACCUSATION.
CASE INSIGHT | Identifying details have been withheld to protect client confidentiality.
What began as a commercial partnership changed dramatically when the business relationship deteriorated and one partner was accused of breach of trust involving a substantial sum.
The defence went beyond a simple denial. It focused on the financial records, banking controls, and the parties’ previous communications.
The evidence demonstrated that:
• Company funds had been distributed between both parties according to a consistent pattern.
• Transfers required a secure authorization device controlled by the other party.
• Company cheques required both partners’ signatures.
• Earlier communications acknowledged a genuine partnership, contradicting the later account presented in the complaint.
This documentary trail helped establish that the matter was a commercial and civil dispute—not a criminal breach of trust. The case concluded with a full acquittal.
The key lesson: the seriousness of an accusation cannot replace evidence, and a failed business relationship does not automatically create a crime.
