Our Advocate Jaber Al Ameri presented another informative workshop regarding the new changes in the UAE Bankruptcy Law, among others. In light of such changes:

- when the court declares the bankruptcy of a company and the company’s funds are insufficient to pay at least 20% of its debts, the court can quantify the exact amount that the members of the board of directors and managers must pay of the remainder of the company’s debts. The directors and the managers can appeal the court’s decision such an appeal does not halt the judgement;

- the members of the board of directors, the managers and the liquidators of a company that has been declared bankrupt by a final judgement can be punished with imprisonment for a period not exceeding two years and/or with a fine not exceeding AED 100,000;

- the court can issue a decision pursuant to which the members of the board of directors and managers, among other things, can be banned from travelling and their assets can be frozen. Such decision can be appealed under the Civil Procedure Law.
