Can a father leave the family home to one child, and leave his wife and other children out of the Will entirely?

That was the question in Shumilayi Moyo & 3 Others v David Junior Isheunesu Moyo & Another. Luka Gondo’s Will left his only immovable property to one daughter. The rest of the family challenged it, arguing he lacked capacity and had been unduly influenced. The High Court disagreed and upheld the Will.

Zimbabwean law protects freedom of testation. A Will isn’t invalid just because it excludes people who expected to inherit, and family disappointment alone isn’t enough to overturn it.

Make your wishes clear. A properly executed Will is what gives them legal weight.

This is commentary on a reported judgment, not legal advice for your situation. Every case is different.

POOR WEALTH MANAGEMENT: THE LEGAL RISKS

You can spend decades building wealth — and lose its value, control or continuity through poor legal planning.

Without proper wealth management, you may expose yourself and your family to:

⚖️ Family disputes over inheritance
⚖️ Property and assets being tied up in deceased estates
⚖️ Intestate succession where there is no valid Will
⚖️ Unnecessary litigation between beneficiaries
⚖️ Poorly structured ownership of property and businesses
⚖️ Loss or fragmentation of family assets across generations
⚖️ Business disruption following the death of a key shareholder or founder
⚖️ Unclear succession and control of family wealth
⚖️ Assets being sold when the founder intended them to remain within the family

WEALTH WITHOUT A LEGAL STRUCTURE CAN BECOME A DISPUTE FOR THE NEXT GENERATION.

At CHABVEKA SOLICITORS, we assist with Wills, Family Trusts, Estate Planning, Succession Planning, Property Structuring and the preservation of generational wealth.

Build wealth. Structure it. Protect it. Preserve it.

WEALTH MANAGEMENT
Your wealth needs more than growth. It needs legal protection.

WHAT IS WEALTH MANAGEMENT?

From a legal perspective, wealth management is the deliberate structuring, protection, preservation and transfer of assets during your lifetime and to future generations.

WHY ENGAGE A LAWYER?

A wealth management lawyer helps you put the right legal structures around what you have built.

At CHABVEKA SOLICITORS, we assist with:

⚖️ Family Trusts — structuring assets for long-term family benefit.

⚖️ Wills & Estate Planning — determining how your wealth should be administered and distributed.

⚖️ Succession Planning — creating continuity for family businesses and valuable assets.

⚖️ Property Structuring — legally organising and protecting real estate holdings.

⚖️ Asset Protection — reducing unnecessary exposure and safeguarding valuable assets.

⚖️ Deceased Estates — providing legal guidance in the administration and transfer of inherited wealth.

Owning assets creates wealth.
Proper legal structures help preserve it.

⚖️ CHABVEKA SOLICITORS | CASE COMMENTARY

Nyamutswa v Nyamutswa HCH 1599/21, HH 41-26 (2026)

The High Court has reinforced an important principle in divorce proceedings: joint registration of property does not guarantee a 50/50 division.

Despite both major properties being jointly registered, the wife was awarded 100% of the Colne Valley property and 60% of the Vainona property, largely because her documented direct financial contribution was substantially greater. The Court nevertheless recognised the husband's indirect contributions.

A potential weakness in the judgment, however, is the difficult balance between this approach and the principle in Usayi v Usayi that marriage is not a business arrangement in which spouses keep receipts in anticipation of divorce, and that both direct and indirect contributions facilitate property acquisition.

The judgment arguably places considerable weight on documented financial contribution, creating a risk that non-financial domestic and family contributions may be undervalued. This raises an important question:

Should the spouse who can produce the most financial records necessarily walk away with the greater share of jointly owned property?

At Chabveka Solicitors, we believe Nyamutswa is an important reminder that property sharing on divorce remains highly fact-specific—and that 50/50 is a starting point, not an automatic entitlement.
