To prove urgency in terms of Rule 6(12) of the Uniform Rules of court, a litigant must show that he/she will not be able to obtain substantial redress at a later hearing in due course and urgency must not be self-created. A Litigant must therefore launch such an application at the first available opportunity and not wait and stand the risk of the matter losing its urgency. Our case law is extensive and launching urgent applications requires a good knowledge of the law as you are essentially asking the court to dispense with the normal formalities of giving an opposing party enough time to oppose a matter adequately. In the matter of Thabo Bester, the Judge dismissed the urgent application on the basis that it lacked urgency.
