We honour the legacy of Lilian Ngoyi, Helen Joseph, Rahima Moosa, Sophia Williams-De Bruyn, and the thousands of women who stood together with courage, unity and resilience.

Our firm successfully obtained an order in the Kempton Park Magistrates’ Court declaring a debtor’s immovable property specially executable in terms of section 66(1)(a) of the Magistrates’ Courts Act, following the Court’s consideration of all procedural and constitutional requirements.

This outcome reflects our commitment to strategic litigation, procedural precision and protecting our clients’ rights throughout the debt recovery process.

A positive outcome was achieved in court today following the withdrawal of an immigration related charge against our client.

Our client had been charged with assault and a further charge of illegal immigrant, in terms of section 49 of the Immigration Act 13 of 2002, was subsequently added. The client consistently maintained that he was lawfully present in the Republic and held a valid visa permit.

Acting on our client’s instructions, we engaged with the Department of Home Affairs and obtained official verification confirming the validity of the permit. Representations were submitted to the prosecution requesting the withdrawal of the immigration charge. Although the initial request was declined, the matter was postponed to allow the State to verify the information independently.

Following that verification process, the State today withdrew the immigration related charge.

This matter highlights the importance of thorough legal representation, careful scrutiny of the evidence and ensuring that prosecutorial decisions are informed by verified facts.

There are moments in legal practice that remind us why we chose this profession.

Recently, Thabiso Sefara had the privilege of assisting a client who, at the beginning of her matter, was unable to afford legal representation. We accepted her case on a contingency basis because we believed in the merits of her claim and in her right to access justice.

After a long journey, the matter has now been successfully settled.

After a prolonged and contested litigation, we are proud to share that a final Protection Order was granted in favour of our client today.

The Domestic Violence Act remains one of the most important pieces of legislation aimed at protecting vulnerable persons and restoring dignity, safety and peace within homes, relationships and families. The Act recognises that domestic violence is not limited to physical assault alone but includes emotional, verbal, psychological, sexual, economic abuse, intimidation, harassment, spiritual, controlling behaviour and damage to property.

Importantly, the law protects people in a wide range of domestic relationships including married couples, life partners, people in dating relationships, former partners, family members, persons sharing a residence and even relationships where one party perceives an intimate relationship to exist.

A Protection Order granted by the court does not simply ‘expire’ after a few months. It remains enforceable unless set aside by a court. In addition, the court automatically issues a suspended Warrant of Arrest together with the order, allowing law enforcement authorities to act swiftly should the respondent breach any condition of the order. This gives victims immediate legal protection and meaningful recourse against continued abuse.

We obtained another favourable order today on behalf of our client, in an application to vary a divorce order.

The matter was initially opposed by the respondent, who had also provided incorrect pension fund details, which delayed the proper finalisation of the issue. Despite the opposition, the respondent’s legal representative later withdrew from the matter after it became clear that there were no legal grounds to persist with the defence.

The court accordingly granted the variation order as sought.
