But before falling in love with a property, it pays to look a little closer.

When viewing a property, keep an eye out for:

✔ Damp or water damage
✔ Signs of mould growth
✔ Cracks in walls or ceilings
✔ Roof condition and leaks
✔ Drainage issues after heavy rain
✔ Boundary walls, fences, and obvious maintenance concerns

This is especially important in the Garden Route, where rain, moisture, coastal air, and vegetation can affect properties over time.

A careful inspection today can prevent expensive surprises tomorrow.

🌧️ Storm Damage: Who Is Responsible?

The recent storms across the Garden Route have caused unexpected leaks, damp, mould, and roof damage — even in homes that have never had these issues before.

A question we are hearing more often is:

Who is responsible when storm damage is discovered during a property transfer?

🏠 Before Registration
The property remains the seller’s responsibility until transfer is registered in the Deeds Office.

If storm damage occurs before registration:
✔️ Notify the estate agent immediately.
✔️ Notify the transferring attorney.
✔️ The seller should contact their insurer.

🏡 After Registration
Once registration has taken place, the property (and the risk) passes to the purchaser.

If damage is discovered after registration:
✔️ Contact your insurer as soon as possible.
✔️ Arrange for the necessary inspections and repairs.

⚠️ Every transaction is unique, and the timing of the damage, occupation date, and provisions of the sale agreement can affect responsibility.

If you are uncertain, speak to your transferring attorney before authorising major repairs.

When Van Tonder Inc opened its doors in 2011, the goal was never to become the biggest law firm in town.

Bernard wanted the freedom to work hard without missing the important moments at home. To build relationships with clients, while still having time for relationships in the community. First and foremost, he is a family man.

Along the way, he discovered that the "Outeniqua Roes" is surprisingly easy to overcome. Do what you say you will do. Don't make promises you can't keep. Communicate. Show up.

Most of our growth has happened the old-fashioned way. One client tells a friend. An estate agent makes a recommendation. A family member passes on a name.

Fifteen years later, we remain grateful for every person who has trusted us with one of life's biggest transactions.
