WILLS:
Do I need to write one really?
Well, let's find out.

What's a will?
It is a legal declaration stating all of one's wishes regarding how all their belongings shall be administered after their demise.
It can either be oral or written.
The writer of a will is called the Testator.

What do I need to write a will?
1. Must of legal age that is 18 yrs and above
2. Must be of sound mind
3. Must be exercising free will
4. 2 witnesses who are not of blood relation
5. Inventory of all your belongings
6. Visit a qualified Advocate

Oral wills are only valid when made before 2 witnesses and within 3 months of the testator's death.

You don't have to wait until you've amassed all the wealth to write a will, Start Now, The earlier the better.

Testate Succession:

This is the distribution of one's estate in line with the Will they left.
The person named as an executor in the Will obtains a grant of probate from Court wishes proves the will.

Once the grant is made the executor distributes the estate of the deceased as per the Will.

Therefore one must have a valid Will for testate succession to apply.

Write your Will now, The earlier you do, the better.

Succession planning in Kenya:
In Kenya, Succession is seen as the process of bequeathing ones assets and responsibilities to the next generation. Where there's a plan it's regarded as testate succession whereas where there's no plan then intestate succession takes place.
In Kenya, Succession is guided by the Law of Succession Act and mainly takes effect upon one's demise.
Upon death, the question remains if they had a plan or not.

Failing to plan is planning to fail.

Both are all about planning for the future ahead and setting grounds rules on what shall be in relation to one's wealth and responsibilities.

Estate planning involves planning for what shall happen to one's estate upon their death. This includes but is not limited to writing of wills.

Succession planning involves planning for the transition of one's estate i.e. who shall take over in event of incapacitation or retirement. This includes but is not limited to trust formation.

Estate vs Succession planning have been used interchangeably yet they bear distinct features. one can take effect in the life time of someone while another only takes effect upon one's death.
