Info to consider in a divorce:
• If you are considering a divorce, have a discussion with your spouse about the division of assets. Don’t leave it to your attorney to fight that battle. This is the person you loved and shared your life with. You will be able to accomplish so much more with a civil discussion as opposed to antagonising them with threats of talking to your lawyer. Once these issues are sorted, then see your attorney, preferably jointly to avoid separate and sometime exorbitant costs.
• In the same vein talk about how you will exercise contact with children borne of the marriage. Make sure it is a workable plan that doesn’t hamper the lives of the children or frustrate the efforts of the spouses.
• Note that in terms of the Children’s Act, children have a say on the parenting plans set out by their parents. Of course this is dependent on the age of the children and their appreciation of it.
• It is a common misunderstanding that where a parent does not contribute to maintenance of a child / children that the erring parent does not have rights of contact with the minor/s. this is incorrect. However, continued non maintenance and failure to exercise rights of contact can result in an application by the custodial parent for the termination of the other’s rights. This is not an easy process and the courts are reluctant to grant such orders.
• Maintenance orders are not cast in stone. The courts are available to vary said orders as children’s needs and parent’s circumstances change.
