Legal awareness lies at the base of any effort toward legal empowerment. Critical knowledge of legal provisions and processes, coupled with the skills to use this knowledge to realize rights and entitlements will empower people to demand justice, accountability and effective remedies at all levels. Today we organized our free legal aid camp at Kusumpur Village. our main topic was to aware girls and women about their legal rights. We discussed about so many legal topics related to women’s like domestic violence, dowry deaths and cyber crimes and their rights against these crimes. Our legal team participated with good zeal and full of enthusiasm .Kudos to our legal team and Delhi police.

भारतीय दंड सहिंता की धारा 420 – जब कोई व्यक्ति करके किसी प्रकार से कपट पूर्वक या बेमानी करके किसी अन्य व्यक्ति को धोके मे रखकर उसकी चल या अचल सम्पति को अपने बना लेता है तो ऐसी स्तिथि मे अपराधी पर भारतीय दंड सहिंता की धारा (आईपीसी) 420 के तहत कार्यवाही की जाती है
1- नकली हस्ताक्षर करके = अगर कोई व्यक्ति नकली हस्ताक्षर करके किसी की चल व अचल सम्पति को अपने बना लेता है तो वह भी भारतीय दंड सहिंता की धारा 420 के अंतर्गत आता है।
2- दस्तावेजो को बदल देना = आईपीसी की धारा 420 के अंतर्गत किसी के दस्तावेजो का हेरफेर करके उसको क्षति पहुँचाना व उसको मानसिक क्षति या आर्थिक क्षति होती है तो आईपीसी की धारा 420 के तहत सज़ा का प्रवाधान है
3- किसी अन्य की सम्पति को किसी और को दे देना = किसी अन्य व्यक्ति की सम्पति को किसी दूसरे व्यक्ति को अपने कहकर सौंप देना या बेच देने पर आईपीसी की धारा 420 का प्रवधान है।
4- अगर कोई भी व्यक्ति ऐसा कुछ करता है तो हमारा समाज उसको 420 के नाम से ही पुकार ने लगता है।
सज़ा – भारतीय दंड संहिता की धारा 420 के तहत किसी व्यक्ति को कपट पूर्वक या बेमानी कर आर्थिक, शारीरिक, मानसिक, सम्पति या ख्याति सम्बन्धी क्षति पहुंचाना शामिल है। यह एक गंभीर व दंडनीय अपराध है। इसके तहत साल तक के कठोर कारावास की सज़ा का प्रवाधान है।

भारतीय दंड सहिंता की धारा 294 के तहत सार्वजनिक स्थान पर किसी भी प्रकार की अश्लील हरकते व अश्लील गाने जैसे अपराध पर लगाई जाती है। अगर ये अपराध किसी भी प्रकार से सिद्ध हो जाता है तो आईपीसी की धारा 294 के तहत 3 महीने की कैद व जुर्माना या दोनों हो सकता है।

भारतीय दंड सहिंता की धारा (120 ए, 120 बी ) किसी भी अपराध की साझा साजिस व अपराध को अंजाम देने यानि कॉमन कॉन्सपिरेसी का मामला गुनाह की स्थान मे आता है। ऐसे मामलो मे भारतीय दंड सहिंता की धारा आईपीसी 120 ए और 120 बी का प्रावधान है। किसी भी मामले मे जिसमे आरोपियों की संख्या एक से अधिक होती है। तो ऐसी स्तिथि मे पुलिस द्वारा एफ़आई आर मे आमतौर पर आई पी सी की धारा 120 ए का जिक्र जरूर होता है। यह जरुरी नहीं की अपराधी किसी अपराध को स्वयं अंजाम दे। किसी अपराध की साजिश रचना व उसमे शामिल होना भी अपराध कहलाता है। अपराध करने पर अपराधी को अपराध के अनुसार फांसी, उम्रकैद या दो वर्ष या उससे अधिक अपराध के अनुसार कठिन कारावास से दंड डाला जाता है। आपराधिक साजिश मे शामिल होने पर कठिन कारावास मे शामिल किया गया है, धारा 120 बी के तहत अपराधिक साजिश रचने, व बनाने पर अपराध करने वाले के बराबर सजा मिलेगी। अन्य मामलो के तहत यह सज़ा 6 माह की सज़ा व जुर्माना दोनों हो सकते है।

समाज मे किसी भी प्रकार की अश्लीलता फैलाना एक संगीन अपराध है किसी भी प्रकार की अश्लील चित्र, फ़िल्म, साहित्य को दिखाना व समाज मे वितरित करना और इसका व्यापार करके किसी भी प्रकार का लाभ कमाना या कोई भागीदारी रखना क़ानून की नज़र मे अपराध कहलाता है ऐसे अपराध करने पर आईपीसी की धारा 292 लगाकर कारवाही की जाती है। इसके दायरे मे वो सब लोग भी आते है जो इस व्यापार को करने मे सहायता करते है या ऐसी सामग्री अपने पास रखते है। या उनके पास से ऐसी कोई सामग्री बरामद होती है अगर कोई पहली बार मे आईपीसी की धारा 292 मे दोषी पाया जाता है तो उसे 2 साल की कैद और दो हज़ार रूपए तक का जुर्माना हो सकता है। दूसरी बार या बार बार दोषी पाए जाने पर 5 साल तक की कैद और पाँच हज़ार जुर्माना तक हो सकता है

PROCEDURE FOR ADOPTION

🤱🤱🙎‍♀️🙇🏻‍♀️🙇🏻‍♂️🙍🏻‍♂️

Adoption means a legal process that allows someone to become the parent of a child, even though the parent and child are not related by blood. But in every other way, adoptive parents are the child's parents.

WHO CAN ADOPT
As per Juvenile Justice (Care & Protection of Children) Act 2000 as amended from time to time, the court may allow a child to be given in adoption -
1. to a childless couple
2. to parents to adopt a child of the same s*x irrespective of the number of living biological sons or daughters
3. to a person irrespective of marital status
Note: A single male is not permitted to adopt a girl child

The parents intending to adopt are called Prospective Adoptive Parents (PAPs).

Child could be orphan or abandoned or surrendered child.

ADDITIONAL ELIGIBILITY CRITERIA
1. For married couple who are Prospective Adoptive Parents (PAPs)
i) 2 years of stable relationship
ii) To adopt children in the age group of 0-3 years:
a) the maximum composite age of the PAPs should be 90 years and
b) the individual age of the PAPs should not be less than 25 years and more than 50 years
iii) To adopt children above three years of age:
a) the maximum composite age of the PAPs should be 105 years and
b) individual age of the PAPs should not be less than 25 years and more than 55 years.
2. For single PAP desiring to adopt
i) Age should not be less than 25 and more than 50. The maximum age shall be:
a) 45 years to adopt children in the age group of 0-3 years and
b) 50 years for adopting children above 3 years
ii) Single male is not permitted to adopt a girl child
3. PAPs should have adequate financial resources to provide a good upbringing to the child.
4. PAPs should have good health and should not be suffering from any contagious or terminal disease or any such mental or physical condition which may prevent them from taking care of the child.
5. A second adoption is permissible only when the legal adoption of the first child has been finalized.

1. Hindu Adoption AndMaintenance Act 1956
2. Juvenile Justice (Care AndProtection) Act 2015


PROCEDURE FOR ADOPTION
Every resident Indian Prospective Adoptive Parent (PAP), who intends to adopt a child, shall register online in Child Adoption Resource Information and Guidance System by filling up the application form as provided in Schedule-5 and uploading the relevant documents.

ADOPTION PROCEDURE FOR RESIDENT INDIANS
1.​Online Registration:Prospective Adoptive Parents (PAPs) should apply for adoption to SpecialisedAdoption Agencies (SAA) through Child Adoption Resource Information and Guidance System (CARIGS) by filling up the online application form and uploading the relevant documents thereby registering themselves as PAPs.
• PAPs should opt for desired State or States at the time of registration.
• In the application, the PAPs should select a SAA nearest to their residence for Home Study Report (HSR) in their State of habitual residence.
• Registration number of PAPsshall be available with all the SAAs in those State or States, as the case may be.
• The registration shall be complete and confirmed to the PAPs on receipt of the completed application form and requisite documents on CARIGS.
• The documents shall be uploaded within 30 days from the date of registration or else the PAPs will have to register afresh.
• The PAPs will get their registration number from the acknowledgement slip and use it for viewing the progress of their application.
2.​Home Study Report (HSR): The HSR of the PAPs shall be prepared through the social worker of selected SAAwithin 30 days from the date of submission of requisite documents.
• In case they are unable to conduct HSR within stipulated time, they shall take the assistance of a social worker from a panel maintained by the State Adoption Resource Agency (SARA) or District Child Protection Unit (DCPU), as the case may be.
• The HSR is shared with the PAPs immediately, thereafter.
• The HSR is posted in the CARIGS by the SAA as soon as it is complete.
• The HSR remains valid for 3years and shall be the basis for adoption of a child by the PAPs from anywhere in the country.
• PAPs are declared eligible and suitable by the SAA based upon the HSR and supporting documents
• In case any PAP is not declared eligible or suitable
o The reasons for the same shall be recorded in the Child
​Adoption Resource Information and Guidance System.
o PAPs may appeal against the decision of rejection to the Authority as provided regulation 59.
o The appeal referred to in sub-regulation (14) shall be disposed of within a period of 15 days and the decision of the Authority in this regard shall be binding.
• Adoption of a child by the PAPs, after completion of their registration and HSR, shall depend upon the availability of a suitable child.
3. ​Referral: Referral is a process the profile, i.e., photographs, Child Study Report and Medical Examination Report of the 3 children (depending on availability) are forwardedonline by Recognised Indian Placement Agency(RIPA)/SAA to the PAPs for acceptance in their preference category, if any. PAP are shown child on the basis of seniorityi.e., as per the date of uploading of documents and completion of registration process in CARIGS).
4.​Reserving of Child: After viewing the profile of the child or children, the PAPs canreserve one child within a period of 48 hours and the rest of the children would be released by CARIGS for other PAPs in the waiting list.
5.​Meeting the Child Reserved: The SAA shall get the details of the PAPs through the CARIGS and fix an appointment with the PAPsfor meeting the child and to assess the suitability of the PAPs by an Adoption Committee.
• Entire process of matching should be completed within a maximum period of 20 days from the date of reserving the child.
• The SAA shall counsel the PAPs when they visit the agency for matching.
• The PAPs may also get the Medical Examination Report of the child reviewed by a medical practitioner of their choice before giving their acceptance for adoption of the child.
• While accepting the child, the PAPs shall sign the Child Study Report and Medical Examination Report which may be downloaded from the CARIGS, in the presence of the social worker or chief functionary of the SAA and the SAA shall record the acceptance by the PAPs in the CARIGS.
• In case the PAPs are not selected for the child by the Adoption Committee, the reason for non-selection of the prospective adoptive parents shall be recorded in the CRAIGS.
• If grounds of rejection are found to be due to systemic error or on non-justifiable reasons, seniority of the PAPs shall be retained else the PAPs shall be lowered to the bottom of the seniority list.
• The registration of PAPs shall continue till child adoption, with revalidation of the Home Study Report(HSR) in every 3 years.
6. Pre-Adoption Foster Care:The child shall be taken in pre-adoption foster care by the PAPs within 10 days from the date of matching, after signing the pre-adoption foster care undertaking for temporary custody. During such period of foster care, the PAPs, shall have the right to take the child to any place within the country after duly informing the RIPA/SAA. However, the child must be brought for the legal process as and when required by the Court. Before physically entrusting the child to the PAPs, the adoption agency will ensure that they have record of local contacts of the PAPs including contact details of two close relatives.
7.​Legal Procedure after Child is Accepted for Adoption: The SAA shall file an application in court where the SAA is located, with relevant documents in original within 10 working days of child being accepted by PAPs for adoption for obtaining the adoption order from court.
• In case of siblings or twins, the SAA shall file single application in the court.
• The court will hold the adoption proceeding in-camera and dispose of the case within a period of 2months from the date of filing of the adoption application by the SAA.
• The adoptive parents are not be asked in the adoption order to execute any bond or make investment in the name of the child, considering the fact thattheir psycho-social profile and financial status have already been ascertained from the HSR and other supporting documents.
• The SAA shall obtain a certified copy of the adoption order from the court and shall forward it to the PAPs within 10 days and it shall also post a copy of the order and update the relevant entries in the CARIGS.
• Registration of an adoption deed shall not be mandatory as per the Act.
8.​​Obtaining Birth Certificate of the Child: The SAA shall apply to the birth certificate issuing authorityfor obtaining the birth certificate of the child within 3 working days from the date of issuance of adoption order, with the name of adoptive parents as parents, and date of birth as recorded in the adoption order and the same shall be issued by the issuing authority within five working days from the date of receipt of the application.
9.​Follow-Up of Progress of Adopted Child: The SAAwhich prepared the Home Study Report, shall prepare the post-adoption follow-up report on 6 monthly basis for 2 years from the date of pre-adoption foster placement with the PAPs, in the required format and upload the same in CARIGS along with photographs of the child.
• In case the adoptive parents relocate, they shall inform the agency which has conducted their home study and the District Child Protection Unit of the district where they relocate.

There is no tool for development more effective than the empowerment of women. Women empowerment means emancipation of women from the vicious grips of social, economical, political, caste and gender-based discrimination. It means granting women the freedom to make life choices. Women empowerment does not mean ‘deifying women’ rather it means replacing patriarchy with parity. As far as Hindu women’s rights are concerned, are well protected under law,however there are certain sections of minority’s who are left out with the equal protection under the constitution of India. One of the deprived section are Protection of law relating to Muslim women. The government ‘s recent initiative to grant protection under law relating to marriage of Muslim woman by bringing an ordinance banning triple talaq and making it a criminal offence.The use and status of triple talaq in India has been a subject of controversy and debate. Triple Talaq is the process of divorce under Sharia Law (Islamic law) where a husband can divorce his wife by pronouncing ‘Talaq’ three times. This is also called oral talaq

Challenges in banning Triple talaq

1 Religious groups infer the banning of a traditional practice sanctified by Sharia as interfering in the religious aspects of minorities.
2 The courts should decide two things basically:
A-Whether personal law can be subject to the constitution or not
B-How to view the relationship between triple talaq and Muslim personal law.
Ordinance on Triple Talaq:
The Government formulated a bill called The Muslim Women (Protection of Rights on Marriage) Bill, 2017 and introduced it in the Parliament which was passed on 28 December 2017 by the Lok Sabha. The bill makes instant triple talaq (talaq-e-biddah) in any form — spoken, in writing or by electronic means such as email, SMS and WhatsApp illegal and void, with up to three years in jail for the husband.Since the Bill could not get the parliamentary approval, the fresh ordinance was issued.Seeking to allay fears that the proposed law could be misused, the government has included certain safeguards in it such as adding a provision of bail for the accused before trial.While the ordinance makes it a "non-bailable" offence, an accused can approach a magistrate even before trial to seek bail.
In a non-bailable offence, bail cannot be granted by police at the police station itself.
A provision has been added to allow the magistrate to grant bail "after hearing the wife", the government had said.The proposed law would only be applicable on instant triple talaq or 'talaq-e-biddat' and it would give power to the victim to approach a magistrate seeking "subsistence allowance" for herself and minor children.
Muslim women have had an extremely difficult time developing under the oppression of a male-dominated society, class and religion .But now it’s the time to break silence. Women are entitled to respect. Of course, there is a need to change our mindset and the patriarchal views that have engulfed Indian mindsets since ages.

Women Empowerment has become a highly debated social issue not only in India but also around the Globe. Women empowerment has become a significant topic of discussion in development and economics. Women’s empowerment and achieving gender equality is essential for our society to ensure the sustainable development of the country. Many world leaders and scholars have argued that sustainable development is impossible without gender equality and women's empowerment. Women’s empowerment is all about equipping and allowing women to make life-determining decisions through the different problems in society.
Empowerment includes the action of raising the status of women through education, raising awareness, literacy, and training.

The Women's Empowerment Principles

Principle 1: Establish high-level corporate leadership for gender equality.
Principle 2: Treat all women and men fairly at work – respect and support human rights and nondiscrimination.
Principle 3: Ensure the health, safety and well-being of all women and men workers.
Principle 4: Promote education, training and professional development for women
Principle 5: Implement enterprise development, supply chain and marketing practices that empower women
Principle 6: Promote equality through community initiatives and advocacy
Principle 7: Measure and publicly report on progress to achieve gender equality

Women empowerment in India

The principle of gender equality is enshrined in the Indian Constitution in its Preamble, Fundamental Rights, Fundamental Duties and Directive Principles. The Constitution not only grants equality to women, but also empowers the State to adopt measures of positive discrimination in favor of women. Within the framework of a democratic polity, our laws, development policies, Plans and programs have aimed at women’s empowerment in different spheres. The National Commission for Women was set up by an Act of Parliament in 1990 to safeguard the rights and legal entitlements of women. The 73rd and 74th Amendments (1993) to the Constitution of India have provided for reservation of seats in the local bodies of Panchayats and Municipalities for women. The Government of India attempted to gender sensitize the Budget initially through the Women’s Component Plan. This highlights the budgetary allocations for 100 percent women specific programs (Part A) and those programs in which at least 30 percent flows to women (Part 😎 in the annual expenditure budget.
However, there still exists a wide gap between the goals enunciated in the Constitution, legislation, policies, plans, programs, and related mechanisms on the one hand and the situational reality of the status of women in India, on the other. Consequently, the access of women particularly those belonging to weaker sections including Scheduled Castes/Scheduled Tribes/ Other backward Classes and minorities, majority of whom are in the rural areas and in the informal, unorganized sector – to education, health and productive resources, among others, is inadequate. Therefore, they remain largely marginalized, poor and socially excluded.
The government has recognized these paradoxes and attempted to address these in policies, legislation and programs. Development programs introduced to bring gender equality have produced mixed results. Legislative changes have faced resistance in their implementation due to social, cultural and religious mores.

We have come so far in women empowerment. Now many women are working in diverse careers and are financially independent. But still we have a long way to go. We need to totally eliminate gender inequality. The Government and we, the people have responsibility towards women empowerment. And we can achieve this ‘Millennium Development Goal’ definitely. One day will come, when gender inequality will only be present in the history books.
