Starting November 1, 2025, under Circular 27/2025 of the State Bank of Vietnam:

💰 All domestic transfers from VND 500 million and above must be reported to the Anti-Money Laundering Department.

📌 When an Investment Project Expires – Does the Company Have to Dissolve?

Many businesses worry that once their investment project expires, they must dissolve the company. In fact, that is NOT true! 🚫

👉 The company can still continue to exist and has 3 options:

1️⃣ Extend the investment project
If you wish to continue, you can apply for an extension of the project duration (provided that legal conditions are met).

2️⃣ Terminate the investment project
If you no longer want to implement it, you can complete the procedures to terminate the project without having to dissolve the company.

3️⃣ Carry out a new investment project
After terminating the current project, the company can register and implement a new investment project.

📌 UPDATE ON CUSTOMS REGULATIONS FOR DOMESTIC EXPORT–IMPORT TRANSACTIONS

Many Export Processing Enterprises (EPEs) are still facing difficulties in carrying out customs procedures for domestic export–import transactions.

👉 According to Law No. 90/2025/QH15 (adding Article 47a to the Customs Law):
“Goods for domestic export–import are those delivered and received within Vietnam at the instruction of a foreign trader under a purchase, processing, leasing, or borrowing contract between Vietnamese enterprises and foreign traders.”

👉 Customs procedures and supervision for this type of transaction are currently provided in:

- Decree No. 08/2015/ND-CP (amended by Decree No. 167/2025/ND-CP);

- Circular No. 38/2015/TT-BTC (amended by Circular No. 39/2018/TT-BTC);

- Official Letter No. 16946/CHQ-GSQL dated 30 July 2025 on transactions of purchase, lease, or borrowing between domestic enterprises and EPEs;

- Regulations on bonded warehouses in Articles 85 and 88 of Decree 08/2015 and Article 91 of Circular 38/2015.

✅ Enterprises should compare their actual transactions with these regulations to ensure proper compliance and avoid legal risks.

📢 NEW UPDATE – ONLINE WORK PERMIT APPLICATION FROM AUGUST 7, 2025

According to Decree No. 219/2025/ND-CP, from August 7, 2025, employers can submit applications for both work permits and criminal record certificates for foreign employees entirely online via the National Public Service Portal.

🔹 Procedure:
1. Employers submit the application for a work permit together with the application for a criminal record certificate online.
2. The National Public Service Portal automatically transfers the application to the competent labor authority and the police authority.
3. The police authority issues an electronic criminal record certificate.
4. The labor authority issues an electronic work permit along with the certificate.

⏱ Processing time = Time for issuing the work permit + Time for issuing the criminal record certificate.

✅ Key highlight: Employers only need to carry out a single online procedure, and all results are provided in electronic form, making the process faster and more convenient.
