What if your loved one can no longer sign their name?
An injury, illness, or limited hand mobility can make signing paperwork difficult. When someone cannot write their name but can make a mark, California allows a process called “signature by mark.”
This requires preparation:
• The signer must personally appear before the notary and be properly identified.
• Two witnesses must watch the signer make the mark and sign the document as witnesses.
• One witness writes the signer’s name beside the mark.
• The signer also makes a mark in the notary’s journal, with a witness completing the required information.
The signer must still be willing and aware of what they are signing. A physical difficulty with writing does not, by itself, prevent someone from participating in a notarization.
