Lori and Ben Wurtzel were recently published in the Florida Association of Criminal Defense Attorneys Summer 2023 issue of the "Florida Defender" magazine. Their article "Prosecution of Threats in the Era of School Shootings: Examining the Impact on Children" explains the possible consequences of these incidents that face school-aged children, including possible detention or arrest, academic consequences, and imposition of risk protection orders.

Yesterday, Governor DeSantis signed HB 1297 which amends Section 794.011(2)(a), Florida Statutes to reinstate the death penalty for the crime of Capital Sexual Battery.

The United States Supreme Court found this practice unconstitutional in 2008 in Kennedy v. Louisiana (554 U.S. 407 (2008)). The amended Florida Law includes a passage that USSC case "was wrongly decided and an egregious infringement of the states' power to punish the most heinous of crimes".

Just one week prior, the governor signed SB 450, which modifies Sections 921.141 and 921.142, Florida's capital punishment laws, to make Florida the easiest state in the country to be sentenced to death (moving from a requirement of unananimity to a requirement of 8/12 votes).
