Our clients took their cat, Kitty, for vaccines to Affordable Animal Hospital on Eagle Rock Blvd in LA.

Dr. Adler was rushing, and they believe he did not give the shots carefully. Worse, no one informed them of any known dangers associated with feline vaccines.

Several months later, they found a tumor at the injection site. The new vet — our clients didn’t trust Affordable anymore — told them it was Feline Injection Site Sarcoma, it had to come out, and it might return.

Apparently, a lot has been published about the risks of cancer from feline vaccines manufactured by Merck. But, our clients were told nothing.

The cancer returned and had metastasized. Kitty has needed a lot of treatment, including chemo. She has had to have a leg amputated. Our clients have had to spend tens of thousands, and Kitty and they have suffered greatly.

This is only the first of many wrongs by Dr. Sanchez and Loving Hands Hospital that we will share. We’re starting with a simple one that shows what kind of people they are, morally.

When Dakota died (or in our opinion was killed), Deanna asked for a pro-rated refund of Dakota’s yearly wellness plan and they said no. Shocking, isn’t it?

09/24/2020

Far too often, military families are forced to give up their beloved canine companions when they are transferred, due to discriminatory and inconsistent companion animal policies on military bases. Policies that discriminate against dogs based on breed instead of behavior are not only difficult to enforce, they’re ineffective. And these conflicting policies lead to confusion and heartbreak for military families with dogs.

The Department of Defense needs a uniform, and breed-neutral, policy to ensure that families don’t face the heart-wrenching decision about what to do when they’re transferred to a base with different rules. Championed by Senator Tammy Duckworth (D-IL), a former U.S. Army lieutenant colonel, a breed-neutral companion animal policy is currently included in the Senate version of the National Defense Authorization Act for FY 2021.

Call your Representative. Phone calls have much more impact than emails. If you’re able to make a phone call, please do so. You can use this message: “I’m calling to ask my representative to include breed-neutral pet policies on military bases in the National Defense Authorization Act.” After calling, please send a follow-up email to your U.S. Representative. Personalizing your message will help it stand out.

Please visit the link in our bio to learn about more opportunities (from the Animal Legal Defense Fund) for you to take action on behalf of animals.

Justice Ruth Bader Ginsburg leaves our country changed because of her life’s work. We have lost a brilliant mind, legal icon, and feminist legend. Thank you. Rest In Peace.

“Judge Ginsburg has spent her life making things how they ought to be. Using her gifted mind, honed by indefatigably hard work, she has used the law, always carefully, always defensibly, for all of those left at the margins, for want of a lawyer or a judge with the brilliance and commitment to pull them mainstream. As a lawyer, she was an activist intellectual who brought grace to both roles.”
— Eleanor Holmes Norton

In the U.S., animal protection laws can be enacted and enforced at every level of government.

Most animal protection legislation happens at the state level but there are also a handful of federal laws. Additionally, some cities and counties also pass ordinances to protect animals.

It’s critically important to advocate for better animal protection laws with lawmakers in all government bodies. Each has the power to help.

Thank you to ALDF for this information.

Our client’s beloved Dakota was misdiagnosed and mistreated, causing her to needlessly suffer as her pet parent tried everything in her power to save her. Due to the veterinarian’s lack of transparency and potential cover-up, our client had to say goodbye to her best friend.

Goodbye sweet Gino

If you are thinking of welcoming a furry friend into your home, please consider adopting an elderly dog. Seniors make up the bulk of the 1.2 million dogs euthanized at shelters every year in the U.S.

As of 2019, only 17 states mandate possession bans after a conviction for animal cruelty— and several of those state statutes are limited to specific species or crimes.
__

As of 2019, 16 states statutorily authorize the court in its discretion to order psychological evaluation and treatment for convicted animal abusers.
__

Laws prohibiting the sexual assault of animals vary widely from state to state. Four states (Hawaii, New Mexico, West Virginia, and Wyoming) still do not have any laws prohibiting the sexual assault of animals.
__

As of 2019, 19 states require veterinarians to report suspected animal cruelty and most of those states also grant civil immunity to veterinarians who report.
__

As of 2019, 31 states and the District of Columbia have some kind of “hot car” law.

Unfortunately, the biggest bar to a negligence lawsuit in veterinary malpractice cases is the possible lack of any significant monetary damages for the owner. But, for most owners, their animal companions are more than mere property and a legal action affords some assurance that the negligent veterinarian is held responsible.

Under current law, an animal is viewed as an item of personal property and some courts limit recovery to the cost of replacing the companion animal with another animal. Some courts are coming to recognize that a companion animal is unique and cannot simply be replaced. These courts are beginning to permit larger recoveries that take into account an animal’s intrinsic value, not just their economic value. Law regarding compensation for a companion animal’s death or injury varies from state to state.

RLG CASE ANNOUNCEMENT FOR GORDO’S CASE (pictured here)

Gordo’s parents, May and Jason Ortiz, have filed suit against Peter Vogel DVM and VCA West Coast Specialty and Emergency Animal Hospital for the wrongful death of their beloved family companion who went in for a simple surgery and who died as a result. Plaintiffs believe that defendants knowingly sent Gordo home when he was already deceased and led plaintiffs to believe he was only heavily sedated. Stay tuned for more updates as this important case unfolds.

We sued Rover on behalf of our clients, Jason Richardson and Lauren Astore, here in California. Judge Rupert A. Byrdsong ordered our case go to arbitration, per the clause in all of Rover’s online agreements. We want to share our experience with you as well as all the very valuable things that we have learned about Rover (and any online dog sitting/boarding marketplace) along the way.
Stay in touch with us here, since we will be providing updates regularly with useful consumer awareness information.
To begin, here are some insights when it comes to using apps like Rover and Wag:
During the current pandemic, people are desperate for pet care and inversely, walkers and sitters are desperate for business. Pet caretakers are considered “essential workers” but large ungoverned tech marketplaces like Rover do not seem equipped to carry out these sacred and essential duties. Meanwhile, smaller more legitimate dog walking companies are being forced to close, which leaves clients with only one option: Leave their four-legged family members in the care of these large, potentially high-risk (in our opinion) tech marketplace companies like Rover and Wag.

During a routine wellness check with Dr. Anderson at Otay Pet Vets in Chula Vista, Henry’s eardrum was punctured. The trauma that Henry continues to endure has resulted in him no longer qualifying to serve as support to his owner, a disabled veteran who was recently diagnosed with chordoma. Our client is asking for vet bills to be reimbursed and for Hanover Insurance to pay for a new service dog. #hanoverinsurance #otaypetvets

Ryther Law Group's latest victory for animals: Shortly after our client's cat, "Heaven" (pictured), disappeared near her home and extensive search efforts to find her had begun, our client received a disturbing call from a blocked number. The anonymous caller stated that she had Heaven, but she refused to identify herself, then hung up. Our client in shock and utter fear, quickly found and retained RLG's attorneys, who subpoenaed the phone records from the phone company, tracked down the people who had taken Heaven, and effected Heaven's safe return.

Ryther Law Group's latest victory for animals: After having won $250K during his racing career, "Tomas" the horse (pictured) was slated to be sent to auction -- and subsequent slaughter for his meat -- after his owner died without having left financial provisions for Tomas' care. RLG's tenacious attorneys, retained by a race horse rescue group mere days before the scheduled auction, were able to obtain legal possession of Tomas from the deceased owner's estate. Tomas is now able to live out the rest of his life in a beautiful, natural environment with other rescued retired racehorses like him. Tomas was emaciated, but is slowly gaining weight and learning what it is like to be a horse, instead of a commodity.
