USCIS' latest announcement is intense, and quite frankly meant to create chaos and fear. From the waves of emails, texts, and calls we've been receiving in the last 24 hours, this policy shift is doing exactly what it intended - stoking anxiety and desperate moves.
However, if you read the fine print of the policy memo itself (https://www.uscis.gov/sites/default/files/document/memos/PM-602-0199-AdjustmentOfStatusAndDiscretion-20260521.pdf?fbclid=IwY2xjawR-qH1leHRuA2FlbQIxMQBzcnRjBmFwcF9pZAwzNTA2ODU1MzE3MjgAAR6c4ZLsCWLd1o8sDYsowOXl7-tQ6_wxtZqSGUw0IqA24psr9cVPBu88hn9Odw_aem_Zs3oZ_yfX-C0DybAl0kNFQ) there is clear language that indicates that options remain for filing for a green card from inside the US. What is equally noteworthy is that this latest announcement does not spell out the severe consequences for so many if they leave the US to apply for an Immigrant Visa (to obtain a green card) from a US embassy abroad.
What now? If you have a pending Form I-485 application to adjust status (AKA green card application) OR wish to submit one, NOW more than ever, it is critical to sit with an experienced immigration attorney for a thorough legal consultation.
