A WIN FOR ASYLUM SEEKERS FLEEING DOMESTIC AND GANG VIOLENCE

The Trump Administration had layered on many harmful policies to restrict access to asylum in the United States. These included two decisions by former Attorneys General Sessions and Barr limiting access to protection for victims of severe domestic violence, gang violence, and violence on account of family relationships. Today, the Biden Administration took an important step toward restoring protection by overruling these decisions.

Attorney General Garland reversed Matter of A-B, which severely limited asylum in cases of domestic and gang violence, and Matter of L-E-A, which did the same for violence because of family relationships. People fleeing these types of persecution once again have a chance to obtain permanent protection in the United States.

Former Attorney General Jeff Sessions enacted these policies near the time I was in Dilley, TX representing asylum seekers at the ICE family detention center there. I saw first-hand how these two decisions made winning asylum much more difficult for people who fled severe domestic violence and death threats in Central America.
