Initiative 71 has changed cannabis' status in the district but how do vendors, medical patients, recreational users, lawyers, police and city officials operate ?
Today The Castro Law Firm achieved successful results for our clients by way of nolle prosequi (see definition below).
One client was accused of car rental theft in Virginia and another client was accused of sexual misconduct related charges of a minor in Maryland in two related cases.
In both cases, the charges were dismissed by nolle prosequi. We were able to convince the government their cases against our clients were not as strong as they originally thought and that our clients had strong defenses to the charges.
In either case, the prosecutors decided to not prosecute and the matters were dismissed subject to the prosecutor's decision to retry the cases within a reasonable time that does not violate the speedy trial rights of our clients under the 6th Amendment to the Constitution of the United Staes.
Justice comes in many forms, today it came in the form of three nolle prosequi.
Nolle prosequi; Classical Latin: [ˈnolːe ˈproːsekwiː]) is a legal term of art and a Latin legal phrase meaning "be unwilling to pursue", a phrase amounting to "do not prosecute". It is a phrase used in many common law criminal prosecution contexts to describe a prosecutor's decision to voluntarily discontinue criminal charges either before trial or before a verdict is rendered. - Wikipedia

Police may legally obtain the identification of someone ONLY WHEN they reasonably suspect has committed a crime. If the person is not reasonably suspected of committing a crime, they are not required to provide identification, even in states with stop and identify statutes.
“Where rights as secured by the Constitution are involved, there can be no rule making or legislation which will abrogate them.” Miranda v. Ariz., 384 U.S. 436 at 491 (1966).
On March 11, 2016, The District of Columbia Court of Appeals reversed our client's conviction of possession of cocaine, marijuana and brass knuckles. The Court of Appeals found that the the police arrested our client before there was probable cause to believe a crime had been committed.
The police violated our client's constitutional rights and remanded the case back to the lower court with instructions to suppress all physical evidence found after our client's illegal arrest.
The Court's opinion (link below) narrows and helps to define the bounds of investigatory stops conducted by police.

The client was charged with driving on a suspended or revoked license. Despite two prior convictions of driving on a suspended or revoked license The Castro Law Firm was able to get the charges dismissed for lack of notice of suspension.

The Castro Law Firm was able to secure a judgment against a foreign film distributer who defrauded and sold our client DVD's without authorization or permission. The client is a well known producer and star of many foreign films sold here and abroad.
The Court awarded compensatory damages in excess of $50,000.00 and is considering punitive damages of $150,000.00.

Arlington County Gen. District Court, Virginia.
Today in Arlington County, Tito V.A. Castro, of The Castro Law Firm, successfully defended against an unlawful detainer by the clients commercial landlord.
After a two hour trial and three witnesses the court found that the plaintiffs contentions were meritless and did not support their claims for unlawful detainer.
The client was happy and even the bailiff stopped Mr. Castro to say "good job counselor!"
Congratulations to the client. While this is not the last we will see of this landlord, this was a major victory for the client.

Today The Castro Firm secured default judgment for the client in a case involving stolen DVDs. The client, a famous Ethiopian movie producer and actor, alleged that the Defendant, a local distributor, embezzled and subsequently sold 5,000 copies of his popular Ethiopian movie.
After initially hiring another attorney to handle the matter which was dismissed for failure to prosecute, the Client sought out The Castro Law Firm to vindicate his rights.
