Just finished reading the Supreme Court of the United States opinion in US v. Windsor, the case that dealt with the Defense of Marriage Act. As I looked at news sites and comments from others, I encourage all of you to read the Court's opinion, because it may not be what you think it is or determines. Essentially, the Court has not determined that the definition of marriage is solely and completely the right of the state and not the Federal Government. In this case, the Federal Government under DOMA does not have the right to tell a state how to define what is or is not a legal marriage. If NY, CA, and other states want to consider same s*x marriage as a legal marriage, then the Federal Government must accept this; however, if a state such as Texas does not recognize same s*x marriage as legal, then they are perfectly free to do so. Therefore, from an Immigration perspective, I am not sure how USCIS will give immigration benefits to persons who live in states that do not consider same s*x marriage legal since the Court did not address the issue of "Full Faith and Credit" between states concerning the acceptance of one state's laws in another state. That is a different question that will need to work its way through the courts. What is clear, is that the states have the ultimate authority to determine the definition of what constitutes a valid marriage.

As I continuing to foray into Labor and Employment law, I am amazed at the issues that I hear about in the workplace. My advice to all is to maintain a professional demeanor at all times and exercise common courtesy to everyone that you work with. This will keep you out of trouble 99% of the time.

It seems that my practice as of late has been more focused in Labor and Employment law on both a State and Federal level. Texas is an "at will" employment state meaning that an employer can fire you at any time for any reason or no reason as long as you are not fired for a protected reason( Discriminatory reason, retaliation).

Today will be a fun filled day as I read the Border Security, Economic Opportunity, and Immigration Modernization Act. This is the immigration reform bill introduced in the US Senate by the bi-partisan committee (Gang of 8). The bill is over 800 pages. This may take a few days.

Was ready for the US Senate comprehensive immigration reform bill to come out this week, but I guess that I will have to wait to read the bill next week.
If you are an employer or employee it is very important that you take the time to know your rights in the workforce. Employers should have signs posted in public areas with information concerning your rights and what you can do if you feel they have been violated. Find out where this information is posted at your place of employment and take the time to read the information. You never know when you might need to know what your rights at work are when something unexpected happens.
