This is an eye-opening article from the NY Times about the potential problems resulting from arbitration clauses, which are common (and often identified as non-negotiable) in all sorts of contracts.

Forced individual arbitration often bears little resemblance to court: The rules tend to favor businesses, and judges and juries are replaced by arbitrators whose rulings are difficult to appeal.
