🚨 Why can’t personal injury lawyers tell a jury how much insurance coverage is available?

It’s one of the most frustrating rules attorneys deal with in a personal injury case.

In many cases, evidence that a defendant has liability insurance is generally not admissible to prove that the defendant acted negligently or wrongfully. The reasoning is that jurors could be influenced by knowing an insurance company—not necessarily the individual defendant—may ultimately be responsible for paying a judgment.

But here’s why that can be frustrating for personal injury lawyers:

A jury may look at an injured person’s claim and assume that awarding significant compensation will financially devastate the defendant. What they may not hear is that there could be an insurance policy specifically intended to cover losses arising from the accident.

That can create a difficult dynamic in the courtroom.

Personal injury attorneys have to present the evidence, explain the true impact of the injuries, and fight for fair compensation—while following strict rules about what the jury is allowed to hear.

⚖️ Why aren’t insurance policies disclosed to juries in personal injury cases? Because courts generally restrict evidence of liability insurance when it’s being used to prove negligence or wrongful conduct, helping prevent insurance coverage from improperly influencing the jury’s decision.

At Injury Solutions Law, LLC, we understand the rules insurance companies and personal injury cases operate under—and we fight to make sure our clients’ stories, injuries, and damages are fully understood.

Why can’t a jury hear about insurance in a personal injury case? ⚖️

It’s one of the most frustrating rules for many personal injury attorneys—and it can completely change the way a jury views a case.

In many personal injury trials, evidence that a defendant has liability insurance is generally not admissible simply to prove that the defendant was negligent or able to pay a judgment. That means jurors may be asked to determine fair compensation without being told that an insurance company may ultimately be responsible for paying some or all of the damages.

Why does that matter?

Without that context, jurors may worry that a verdict will financially devastate the individual defendant. That perception can potentially influence how they think about damages—even though insurance coverage may exist behind the scenes.

The rule is intended to keep jurors focused on the facts, liability, and damages rather than whether insurance is available. But for personal injury lawyers, it raises an important question: can leaving insurance out of the conversation create a different kind of bias?

Personal injury law is full of rules the average person never sees until they’re involved in a lawsuit.

Follow for more explanations about personal injury cases, insurance claims, jury trials, settlements, and what really happens inside the courtroom.

Why would a trial lawyer WANT the jury to know his client isn’t paying him by the hour? ⚖️

For Derek Ingle, there’s an important reason.

When a personal injury case reaches trial, jurors may see an experienced attorney standing beside the injured person and assume:

“They must have a lot of money to afford this.”

But that may be far from reality.

Many injured clients could never afford to pay an experienced trial attorney $400–$500+ per hour to take on a major insurance company.

That’s where a contingency fee changes the equation.

Instead of paying thousands—or potentially tens of thousands—of dollars out of pocket as the case moves through litigation, the client is able to pursue their case with the attorney’s fee tied to the recovery.

And Derek wants jurors to understand that.

Why?

Because context matters.

Knowing the client hired their attorney on contingency may help eliminate assumptions about their financial resources and help jurors understand the reality of the fight in front of them:

On one side is an insurance company with the resources to pay lawyers by the hour. On the other is an injured person who may never have been able to afford this fight without a contingency fee.

That doesn’t change the evidence, and it doesn’t change the jury’s responsibility to decide the case fairly.

But it can change the lens through which jurors understand why the client is standing in that courtroom with experienced counsel.

A contingency fee can level the playing field by giving an everyday person access to the same legal system as a powerful insurance company.

And sometimes, making sure the jury understands that reality matters.

It’s not about asking for sympathy. It’s about removing a misconception before it influences how the jury sees the case.

“How does your client afford you?” ⚖️

It’s one of the questions jurors often want to ask during voir dire—and Derek Ingle believes it’s an important one to answer.

Because when an injured person goes up against a major insurance company, the financial playing field usually isn’t equal.

Think of it this way: there are two doors into the courthouse.

🚪 Door #1: Pay an experienced attorney $400–$500+ per hour to litigate your case.

Large insurance companies have the resources to do that.

🚪 Door #2: Hire a personal injury attorney through a contingency fee agreement.

That means the injured client doesn’t have to fund the enormous cost of litigation by paying hundreds of dollars an hour along the way. Instead, the attorney’s fee is contingent upon the outcome of the case and is typically an agreed-upon percentage of the recovery.

Depending on the agreement and circumstances of the case, that percentage may range from roughly one-third to one-half of the recovery.

And that’s a BIG reason contingency fees exist:

Access to the courthouse shouldn’t belong only to the people and corporations who can afford hundreds of dollars an hour in legal fees.

A contingency fee gives everyday people the ability to hire experienced counsel and pursue a claim—even when they could never afford to finance the litigation themselves.

That’s not just about attorney fees.

It’s about access to justice. ⚖️

What is Voir Dire—and why does it matter in a personal injury case? ⚖️

Before opening statements are made or evidence is presented, one of the most important parts of a jury trial takes place: voir dire, commonly known as jury selection.

During voir dire, attorneys have the opportunity to ask potential jurors questions designed to uncover experiences, opinions, or biases that could affect their ability to fairly evaluate the case.

In a personal injury case, this can be especially important. Jurors may come in with preconceived opinions about lawsuits, insurance claims, medical treatment, damages, pain and suffering, or what they believe an injury is “worth.” Voir dire gives attorneys an opportunity to identify those perspectives before the case begins.

The goal isn’t to find jurors who automatically agree with one side. It’s to help seat a jury that can listen to the evidence, follow the law, and evaluate the case fairly and impartially.

Because before a jury can decide the facts of a case, attorneys need to understand the people who will be deciding them.

Voir dire may happen before the trial begins—but its impact can be felt throughout the entire case.

From building fence and watering cattle to giving cows C-sections—Brad Wicker’s path to becoming a personal injury attorney is anything but typical. In fact, growing up on a farm, there was one profession he never imagined choosing:

Lawyer.

Brad grew up understanding hard work long before he ever stepped into a courtroom. Farm life taught him to show up, solve problems, get his hands dirty, and take care of what needed to be done.

And ironically, the kid who hated lawyers grew up to become one.

Today, Personal Injury Attorney Brad Wicker of Injury Solutions Law uses that same work ethic to fight for people who have been injured and need someone in their corner.

Because when you’ve been hurt in an accident, you don’t need someone who just knows the law. You need an attorney who understands hard work, knows how to fight, and hasn’t forgotten where he came from.

📍 Looking for a personal injury attorney in Tulsa, Oklahoma? Injury Solutions Law helps injured Oklahomans understand their options and pursue the compensation they deserve after an accident.

From the farm to the courtroom—Brad Wicker is still fighting for people. The scenery just looks a little different now.
