Here's what most people miss: once L&I makes a decision on a claim, you have 60 days to protest it (back to the same claim manager) or appeal it (to an independent board). Miss that window, and the decision usually stands.

If someone other than your employer caused your injury, a separate third-party claim can run alongside your L&I claim, not instead of it.

An industrial injury (a fall, a machinery accident) has to be filed within 1 year. An occupational disease (something that develops from repeated exposure or job conditions, like carpal tunnel or a lung condition) gets 2 years from written medical notice.

Once L&I classifies a claim one way, it generally cannot be switched to the other category later, even with new medical evidence.

L&I manages about 95,000 workers' comp claims a year in Washington, and one injury tops the list more than any other.

Open wounds of the fingers and fingernails are the single most common accepted L&I claim in the state, and freight workers alone filed about half of all accepted open wound claims in 2022.

A common injury doesn't mean an easy claim. L&I still reviews every case on its own facts, and even the most typical injuries get denied or undervalued.

Starting July 1, Washington raised the fines for employers who break workers’ comp rules, and the violations getting penalized are often the same red flags that show up in delayed or denied claims.
