Here's something every family with a loved one with a disability should know about.
For 25 years, a Supreme Court decision called Olmstead has protected people with disabilities from being forced into institutions when they could be cared for at home and in their community. It's one of the quiet reasons so many families have been able to keep their loved ones close.

That protection just got shakier. Earlier this year, the Department of Justice said it will stop enforcing the rule behind Olmstead, even though the decision itself is still the law. We're already seeing what that looks like in real cases in Florida and Texas.

I wrote up what's happening, why it matters even though the law technically hasn't changed, and what I'd tell my own clients to do right now. Link in the post below. 👇

If this affects your family, please don't wait to ask questions.

"But They Can Do It at Home…"
A child may be capable of doing something under certain circumstances and still need support to do it successfully at school.

For example, a child might:• Complete an assignment with one-on-one support• Communicate differently in stressful environments• Need additional processing time• Become overwhelmed by sensory stimuli• Struggle with transitions• Need visual supports or other accommodations

Every child deserves an educational program designed around their individual needs.

Parents of children with disabilities often receive a lot of information from schools, doctors, therapists, and service providers.
Create a simple system to keep track of:

📌 IEPs and evaluations
📌 Progress reports
📌 School correspondence
📌 Meeting notes
📌 Emails with teachers and administrators
📌 Behavior or incident reports
📌 Outside evaluations
📌 Therapy and service records

Keep copies of important documents and organize them by date.
Good documentation can help you understand your child's history, identify patterns, and communicate more effectively with the professionals supporting your child.

Autism Is a Spectrum. Your Child Is an Individual. 💙
No two autistic children are exactly alike.

One child may need significant communication support. Another may need help with sensory regulation, executive functioning, social interaction, transitions, or behavioral needs.

That's why individualized educational planning matters.

Your child's supports should be based on your child's unique needs, strengths, challenges, and goals: not simply on their diagnosis.

Don't be afraid to ask:
"How does this support address my child's individual needs?"

Labor Day weekend may have marked the unofficial end of summer, but for many families, it also means getting back into the rhythm of school.

For families of children with special needs and disabilities, the new school year can bring important questions:

📚 Does my child have the right supports in place?📝 Is the IEP meeting my child’s needs?💬 Are my concerns being heard?🤝 Does the school understand and support my child?

You know your child best. If something doesn’t feel right, asking questions and seeking information is an important first step.

Marna Solarsh Law is dedicated to advocating for children with special needs and disabilities and supporting families as they navigate their children’s educational needs.

Special Needs Trusts
Planning for Your Child's Financial Future

If your child has a disability, leaving assets directly to your child may not always be the best way to plan for their future.

A Special Needs Trust may be an important component of a comprehensive plan, depending on your family's circumstances and your child's eligibility for means-tested benefits.

The right plan should consider your child's current needs, future needs, government benefits, family circumstances, and long-term goals.

What Happens When Your Child Turns 18?
For parents of a child with a disability, the transition to adulthood can raise important legal questions.

Will your child be able to make decisions independently? What support might they need? Is guardianship appropriate?
Guardianship is a significant legal decision and should be considered carefully based on the individual's abilities, needs, and circumstances. Planning before the age of majority can help families better understand their options and prepare for the transition.

The School Year Is Almost Here! 🎒
A new school year means a fresh start and an opportunity to make sure your child's educational program is ready to meet their needs.

Before the first day, consider reviewing:

📌 Your child's IEP
📌 Current goals and accommodations
📌 Related services
📌 Transportation needs
📌 Assistive technology
📌 Behavioral or communication supports
📌 Recent evaluations and progress reports

Under IDEA, an IEP is a written plan that addresses a child's present levels of academic achievement and functional performance, measurable annual goals, and the services and supports needed for the child.

If you have concerns about your child's educational program, don't wait until the school year is well underway to seek guidance.

If You Have Concerns, Speak Up Early. 💙
Parents know their children better than anyone. If you notice changes in your child's behavior, communication, learning, or ability to participate at school, don't feel that you have to wait until things become a crisis before raising your concerns.

For children with autism and other disabilities, early communication with the school team can be an important part of addressing changing needs.

Keep records. Ask questions. Request meetings when appropriate. And don't be afraid to advocate for your child.

Your concerns matter.
