Closing day feels like the finish line, but the protection you just paid for is only getting started.

Your deed goes on file with the county, which is the official record showing the home belongs to you. And your title insurance starts working. Homeowners insurance covers the house if something happens to it. Title insurance covers your right to the house itself, and it never runs out as long as you own it.

If you got a mortgage, this one's worth asking about. Your lender required a policy that protects the lender. The owner's policy is the one that protects you, and it stays in place for your family too.

Nobody thinks to ask about permits. 👀

Then your buyer is eight months in, the county sends a letter, and it turns out the lanai got enclosed in 2011 and the permit was never closed out. Open permits and code enforcement fines attach to the property, not to whoever left them behind, so they came along with the deed.

The inspector won't flag it, that was never in their scope. And a standard owner's policy doesn't cover zoning violations either, it's a written exclusion, which is something people should hear before closing rather than after.

We run a municipal lien and permit search on residential files so this surfaces while there's still room to negotiate. If something turns up, our attorneys are in-house, so you're not waiting on outside counsel to tell you how bad it is.

Here's what most buyers don't realize: someone else may already have legal rights to part of the property they're buying, and nothing about it shows up during a walkthrough. In older Tampa and Sarasota neighborhoods, fences and driveways have been sitting a few feet off the line for decades, and nobody notices until a sale.

An easement gives another party, usually a utility company or the municipality and sometimes a neighbor, the right to use part of the land. Most are recorded, most are routine, and they still affect what you can build and where. An encroachment is different. That's when a structure like a fence, shed or driveway physically crosses the property line, and it's the one that turns into a dispute.

Either one can limit how a backyard or driveway gets used, complicate a future sale, or affect value.

Here's the part that catches people: a title search surfaces recorded easements and restrictions, but encroachments generally show up on a survey. That's why the two work together, and why a standard policy may not cover survey matters unless a survey is provided.
