Legal Question: Can someone be sued for not closing credit cards as per divorce decree?

Answer: Yes, and no. There are two issues. The first is the ramifications of not complying with the divorce decree. The second is whether there is separate civil liability under a contract theory by the creditor against the debtors (e.g., civil suit or small claims action).

First. Most jurisdictions allow either party to pursue the other’s failure to comply with a material term in a divorce decree. These terms are usually found in the Marital Settlement Agreement (MSA), and are addressed through a Motion for Civil Contempt and Other Relief. If the party who 1) failed to close the credit card account and/or 2) subsequently used the card and incurred more debt in the joint name of both parties, the family court can find for the injured ex-spouse and order the non-complying spouse to pay “damages” (the amount charged on the card) and close the account, or face additional penalties (sometimes jail, depending on the jurisdiction).

Second. Until the card is closed, it is OPEN, and the creditor has the legal right to institute a collections action (civil law suit) against both parties to recover any unpaid balances, including the injured ex-spouse. The divorce decree is binding only upon the parties. The credit card company is not a party to the decree, and accordingly cannot be FORCED to hold harmless a party for failing to pay. However I have been able to negotiate a reduced payment obligation on the part of the injured ex-spouse along with a subsequent agreement to remove that spouse from the account.

Last evening the Sarasota NAACP, with the support of its Youth Council and the Greatness Beyond Measure Teen Summit, hosted an event entitled "The 411 on the Five-O." The goal of the event was to educate the community (particularly our youth) on how to respond when encountered by law enforcement.

This is a first step in the long process of healing and restoring the trust of the community regarding law enforcement's application and enforcement of the laws in predominantly black communities like Newtown. Emotions were raw! The community is desperate for answers on how to end racial profiling, and gain a better understanding of its rights, and how to ensure fair treatment under the law.

Law enforcement needs to evaluate and improve its training in this area, and needs to educate the community on how it trains its officers when responding to calls in the community. Many are weary that all that happens is talk, with no action. However, without education and understanding of the process, nothing will improve. Applied knowledge is power. Please continue to support these efforts!

What if we took more time to affirm our fathers? To remind them of their greatness and their potential. To revive the dreams they won't share with anyone. To inspire them to reach beyond themselves to reach their goals. To give them space to create, invent, and inspire. Would we have more volunteers? More role models? Less crime or violence? Better relationships and less issues of domestic violence? Would our sons and brothers and cousins have a better sense of who and whose they are? Take the time to talk up the men in your circle, not down. Volunteer, mentor, become a Big Brother (or sister). The village needs you!
