On Aug. 13, 2026, the Board of Immigration Appeals (BIA) issued a precedent decision, Matter of Delcarmen-Lara, 29 I&N Dec. 830 (BIA 2026), that overruled Matter of Arrabally and Yerrabelly, 25 I&N Dec. 771 (BIA 2012).

This changes everything for DACA and TPS folks who planned to apply for advance parole as a strategy to become eligible for adjustment of status. There are still ways to work around this decision. But it will not be easy. Contact me if you are in this position and need more information.

Additional requirements for Adjustment of Status will take effect next month. If you do not want to be impacted by the new Public Charge rules contact an immigration law office as soon as possible to get your application filed ahead of time.

On Sept. 18, 2026, USCIS will publish a revised edition of Form I-485, Application to Register Permanent Residence or Adjust Status (edition date: 09/18/26).
