I'm sure most of you have heard in the news that the Federal Government is no longer enforcing the NFA. Please note that this has no impact on Hawaii and California. This decision by the Federal Government does not affect state law at all. And Hawaii and California prohibit suppressors and short barrel r***e and sh****ns through state law. Moreover, the Ninth Circuit has already found that suppressors are not protected by the Second Amendment. In United States v. DeBorba (No. 24-3304), the U.S. Court of Appeals for the Ninth Circuit ruled on June 3, 2026, that fi***rm suppressors (silencers) are not protected "arms" under the Second Amendment. The best chance of suppressors being legalized in Hawaii is through the legislature.

As I mentioned a couple weeks ago, Burton is my knife expert. He submitted expert testimony in both my switchblade and butterfly knife litigation. He is a large part of why those knives are legal in Hawaii today. I previously shared a video he made that showed switchblades do not open faster than legal knives. In this video, Burton showed the same for butterfly knives. I submitted both videos to the court. This destroyed the State’s rationale for banning them. Burton is going to be in San Diego to host a knife fighting seminar Oct. 10 at the Training Center in Pacific Beach. The seminar will be between 11am-130pm. Mr. Mark Pennak who was my Supreme Court co-counsel in Wolford v. Lopez has agreed to join me in Yukutake v. Lopez. Mark worked at the Department of Justice's appellate division for 30 years and has participated in dozens of Supreme Court matters. He taught me much of what I know about appellate law so I am happy he has agreed to help us.

Please share. I need your help. Last week, we lost Yukutake v. Lopez at the Ninth Circuit. That is our challenge to two of Hawaii's registration laws. The laws we are challenging is the in person inspection of fi***rm that are not purchased at a Hawaii based FFL and the law which mandates a 30 day expiration on handgun permits to acquire.

I am going to appeal the ruling to the U.S. Supreme Court. The printing and formatting the petition cost a lot of money. I'm expecting the cost to be around 15,000 just for the application to the U.S. Supreme Court. That is the petition and the reply brief. The Hawaii R***e Association is raising money to help me pay for printing and formatting the briefs. If you are interested in helping out, please go to the link below.
