‎OVERVIEW OF CURRENT STATUS ON BIRTHRIGHT CITIZENSHIP IN THE U.S.

‎Recently, the Trump administration implemented an executive order that modifies the existing framework of birthright citizenship in the United States. Under this order, automatic U.S. citizenship for babies born on American soil would no longer apply unless at least one parent is a U.S. citizen or a green card holder. This policy has faced legal challenges from several states.

‎On June 27, 2025, the Supreme Court issued a 6–3 ruling allowing lower courts to no longer impose nationwide injunctions against federal policies unless the directly affected parties are parties to the lawsuit. Consequently, the executive order can take effect in most states across the country. However, there are exceptions in five states where court orders remain in effect:

‎- Washington
‎- Maryland
‎- New Hampshire
‎- Massachusetts
‎- New Jersey

‎In these states, birthright citizenship continues to apply; thus, babies born there will automatically receive U.S. citizenship at birth, regardless of their parents' immigration status.

SIV UPDATES.

‎This evening, the White House announced that new restrictions on the entry of foreign nationals from nineteen countries, which took effect in June, will soon extend to additional countries that will be specified later.

‎Importantly, while Afghanistan remains on the list of countries facing the most stringent travel restrictions, Afghan Special Immigrant Visa (SIV) holders are exempt from these measures. The Afghan SIV program is still operational, allowing our Afghan allies with Special Immigrant Visas to enter the United States.

‎However, it is crucial to understand that due to the cessation of foreign aid that previously facilitated the evacuation of SIV holders, new SIV applicants must, upon approval, relocate to a recognized country (not Pakistan) to arrange their travel documents privately to the United States.
