Axial Mfg., Inc. Prevails in Lawsuit Against WheelImage Corporation
[April 3, 2024, Anaheim, California] – “As counsel to Axial Manufacturing., Inc., we are delighted to announce that Axial has emerged victorious in the lawsuit brought against Axial and various Axial employees and others by WheelImage Corporation, owned by Adel Batarseh and his son David Batarseh. The Honorable Judge James V. Selna dismissed the WheelImage litigation without granting WheelImage the opportunity to amend its first amended complaint,” said William Palmer. The final ruling by Judge Selna unequivocally favored Axial, stating that "Given that WheelImage does not own a valid, protectable mark [Trademark] and Axial is the assignee of the AL13 mark [Trademark], the Court finds that WheelImage will not be able to correct the deficiencies in its FAC [First Amended Complaint]."
William W. Palmer, attorney for the Axial defendants, commented, "In other words, WheelImage does not own the AL13 Trademark – it never did - and if any member of the public purchases a counterfeit rim of the AL13 brand from anyone other than Axial, then the consumer is being deceived and is not receiving the high-quality production that made Axial’s AL13 world-famous."
Additionally, three former employees, Wrigley Corales, Charles “Vince” Orozco, and Cynthia Acquino, who are currently employed by WheelImage, are being sued by the Estate of Darwin Wongkar in Orange County Superior (Probate) Court Case No. 30-2022-01282326-PR-LA-CMC. That lawsuit alleges the three employees – Corales, Orozco, Acquino – engaged in acts of conversion, fraud, and unjust enrichment based on their involvement in a scheme related to the attempted sale of the AL13 brand and other related acts.
“We must emphasize,” said Mr. Palmer, “that any orders placed through WheelImage are not authentic, potentially actionable, and will not be covered by any warranties. Furthermore, we alert the public that Axial's website is currently compromised and the only legitimate means of contact with Axial are through [email protected] or by calling (657) 239-0820. This will be remedied shortly.”
“Axial Mfg., Inc. remains committed to upholding the integrity of its brand and will continue to take legal action against any unauthorized use or distribution or purchase of its products,” said Palmer.
