Since 2022, I defended my client again a disabled plaintiff Orlando Garcia in an ADA lawsuit. He has filed over 1000 ADA lawsuits under his belt.
He lives in Highlands County Los Angeles, and sued a small place in Salinas California . Yeah we believe he went there to set up a lawsuit! Just when we came down to trial, they threw in a towel and dismissed the case for nothing!! I had hired an investigator to inspect his own apartment. The inspector found out that there was NO disabled ADA van accessible parking and no ADA door hardware. Those are the very two elements that he sued my client over yet he had no ADA access himself!!!! This is a victory!! In my opinion, plaintiff's. counsel was afraid to go to trial!!! I love clients that fight!! I love my client in Salinas!!!!!!

Plaintiff Orlando Garcia, a wheelchair user, is filing lmany ADA lawsuits in several California counties, including but not limited to Monterey County Court, Los Angeles County Court, San Mateo County Court, Orange County, Court, Santa County Court and so forth. He alleges that the business he allegedly visited denied him full and equal access, and did not comply with the Americans with Disabilities Act, so he allegedly could not get into the business. The problem is that he does not intend to enjoy the goods and services, rather he goes there to set up a lawsuit for greenbacks!!

Not All Websites Must Comply with the ADA

The Federal ADA requires websites to be accessible to the disabled, such as the blind who need compatible screen reader software, if the website is connected to a physical place of accommodation. The ADA, however, does not apply to "all" websites. If the website is an "online" service provider without a connection to a physical building, then the ADA does not apply. See Martinez v. Cot'N Wash Inc.

Compare California's disability law which provides a disabled plaintiff with a minimum of $4000 per visit for damages if the plaintiff was barred from the full and equal enjoyment of the goods and services provided. There are two theories that a disabled plaintiff may allege for damages: (1) the plaintiff can obtain damages by proving a violation of the ADA; or (2) the plaintiff can prove that the Defendant intentionally denied access to the disabled.

Attorneys for the disabled have been arguing that they can prove intentional discrimination per the Unruh Act by showing that the website is not compliant, and it has a "discriminatory effect" on the disabled, like the blind being denied access because the website does not have compatible software for their screen readers. That theory has recently been shot down. The California case of Martinez v. Cot'n held that a disabled plaintiff must prove intentional discrimination and it cannot be inferred or implied. The Court also held that if a business's website is an online service provider only without a connection to a physical location (place of accommodation), then the ADA does not apply because the ADA literally requires a "place of accommodation."

The Court reasoned that its job is to interpret the statute and not create new law. Congress or the Department of Justice can create new statutes or regulations to change the existing law to allow for the disparate impact theory but it has not.

This is a very good decision because the Court is interpreting the actual language of the law, and not using politics to expand it.

My clients Michael Lee of the Sandwich Board and Mark Rogers of Lol’s Chicken Shack in Alameda are the only ones in my long legal career to challenge a disabled Plaintiff who has filed over 700 ADA access complaints and who admittedly had no intention to buy their goods and/or services! He is testing their access. He is not engaging in commerce. The ADA does not protect such an abuse of the law and legal system!

We got in the Korean news, the Alameda Sun and CBS San Fransisco news thanks to Abigail Sterling!! Michael Lee has a Go Fund me and needs support to go the distance! I am not charging all of my hours and trying to help. The Courts make us do so much. Please share and help Michael Lee. He is an amazing person, has never been sued in 40 years, took over his family business and sells the best turkey sandwiches in Alameda county!!! He never saw the disabled person come in his business or hear from that person until he got a summons and complaint!!
