Geoff Hamby, Esq. had the honor to be lead counsel for a $5,300,000 jury verdict in Portland, OR. He said it was a dream come true to team up with Marc Johnston of the Johnston Law Firm to try this case. Their firms and trial teams worked together as one machine to push this case over the finish line.

The case was against the world’s largest for-profit school bus company, First Student. They left a school bus driver behind the wheel after receiving direct notice from the drug testing company that he was on two medications that legally disqualified him from driving a school bus. The next week, he caused this wreck. Geoff used Phillip Miller as their trial consultant and tested the case on almost 600 mock jurors through a series of focus groups, surveys, big data presentations, and mock trials. Unfortunately, their motions judge handed down some very difficult pretrial rulings against us dismissing our punitive damages claim and opening the door to defense admitting liability three days before trial.

When that happened, the judge excluded every piece of evidence outside of the facts of the wreck itself and our client’s injuries. The compensatory damages model was a tough one.

Their client is a young lady who was an 18-year-old high school senior at the time of the wreck. She has a brain injury but no accompanying bodily injuries outside of a neck strain that resolved within a couple of weeks. She was on police body cam footage telling the police she was fine after the wreck, did not hit her head, did not lose consciousness, and declined an ambulance at the scene.

A storm took out a stretch of fence this summer.

Nobody on a ranch stands around asking why the tree fell. You cut it up, restring the wire, count the herd, and move on to the next thing that needs you.

Cases have those moments, too. A witness changes. A ruling doesn’t go your way. Something you thought was settled suddenly isn’t.

You deal with what’s in front of you. Fix the fence. Keep moving.

We’re a little different from most firms.

We don’t handle hundreds of cases. We don’t even handle dozens. We intentionally take on a select few so we can give each one the time, attention and work it deserves.

We visit our clients in their homes. We get to know their families. We spend the time to understand not just what happened, but how it changed their lives.

And trucking cases are complicated. They’re not simply red car hitting blue car.

A lot of really good attorneys find themselves with a serious trucking case and wonder, Can I handle this on my own and get a great result for my client? Sometimes, absolutely.

Other times, your client may be better served by bringing in someone who has spent a career working through the unique complexities of these cases — the trucks, the corporate defendants, the data, the regulations and all the details that can make a difference.

We’ll always be honest with you about which one we think it is. We’re not looking to insert ourselves where we’re not needed.

We’d just like the opportunity to have the conversation.

Every case starts with one family. It rarely ends there. When a trucking company is held accountable, it hires more carefully, trains better, and pays closer attention to who it puts on the road. The families who never get that phone call won't know Marc's name either.

On Labor Day, I think about my dad, Eddy. He worked as a line foreman at North Arkansas Electric. Storms meant he went out when everyone else came in.

Today, I also think about people like him. The linemen, the drivers, the welders, the nurses — the folks who build, fix, haul, and hold this country together.

Most of our clients are working people. When their lives get turned upside down, they deserve someone who fights the way they work.

Happy Labor Day. Especially to the ones on call today.
