Here are some classic ways people avoid responsibility for what they have done:

1. Denial: I didn’t do it
2. Distortion: It didn’t happen that way
3. Minimize: It wasn’t that bad
4. Evade: It wasn’t me. It was him

The blame game is the easiest way to attempt to defend your case. But dealing with evasion of personal responsibility is one of the things lawyers need to learn to deal with in representing clients.

Do you need a lawyer who is prepared for your case? Call me today for a free initial consultation at 301-655-8130.

In a world of 140 characters or less, people draw impressions based on the headline. This is no different than the opening statement in your trial case.

In the first few seconds of every encounter we are instantly evaluated. We are observed from head to toe by demeanor, body language and grooming. Within three seconds impressions are formed about us.

So, make sure you have a lawyer who has prepared you for your trial and a lawyer that has a high-quality opening statement.

Proper Deposition Objections — Lawyerist

"Depositions can be tedious, but they are so important in litigation. Deposition testimony can make or break a case. It is sworn testimony that can be used to impeach at trial. It can expose the relative strengths and weaknesses of each party’s case. It can lead to crucial admissions or denials of liability. Through deposition testimony, you can truly push for quantification of damage claims."

Here are a few examples of improper deposition objections:

1. Irrelevant
2. Hearsay
3. Assumes facts not in evidence
4. Calls for an opinion
5. Speaking and coaching objections

Do not let yourself get bullied by an opposing counsel who is making improper objections. Call me today for a free consultation at 301-655-8130 or visit http://www.danielwrightlaw.com for more information.

10 TIPS FOR BETTER LEGAL WRITING

The ABA Journal came out with these 10 tips to improve your legal writing. I use these tips in my writing and interpersonal skills, do you?
For more information click the link below.

1) Be sure you understand the client's problem.
2) Don't rely exclusively on computer research.
3) Never turn in a preliminary version of a work in progress.
4) Summarize your conclusions up front.
5) Make your summary understandable to outsiders.
6) Don't be too tentative in your conclusions, but don't be too cocksure, either.
7) Strike the right professional tone: natural but not chatty.
8) Master the approved citation form.
9) Cut every unnecessary sentence; then go back through and cut every unnecessary word.
10) Proofread one more time than you think necessary.

Throughout your career as a lawyer, you'll be judged professionally on two main things: your interpersonal skills and your writing. Although the requirements of writing assignments will vary depending on

A study of 57 videotaped interrogations of teenagers by the police found that none of them remained silent, suggesting they are particularly vulnerable at such times.

NEED TO BE MORE PRODUCTIVE?

Here are a few quick tips to keep your practice running smoothly:

Bookmark Your PDFs: By bookmarking your PDFs you help readers get to the pertinent information faster. PDFs can be cumbersome and longwinded, so help your client and fellow lawyers out by creating a digital table.

Use Office Templates: Consistency is key in branding. Create a "mostly" finished document and then save it as a template. It will make future work faster and easier to create.

Have Better Meetings: Create a plan of action before the meeting happens, this will help the meeting run smoothly. Also, use meeting planning tools to figure out what times work best for your clients.

HERE ARE 2 THINGS TO CONSIDER BEFORE TAKING A CASE

1. Make Sure The Case Fits Into Your Current Caseload
2. Trust Your Gut

Nothing is worse than having a lawyer who barely gives your case enough time. Check your schedule and make sure you can give your client as much time as they may need. Don't take a case if you are going to be overwhelmed!

If you are on the fence about a case, trust your gut, it will tell you if a case is a recipe for success or disaster!

THE BENEFITS OF SETTLEMENT BEFORE TRIAL

When considering a settlement, lawyers need to examine if the deal is actually in the client’s best interest. If it is, some of the benefits could be less expense, stress, and time with more privacy. With any trial, it involves attaining an attorney, extensive discovery depositions, travel, and time. However, if a case settles before going to trial, then most of these expenses can be reduced or eliminated. It is difficult enough for a client to re-tell their store to an attorney, but often more difficult to re-tell it again to seven strangers (jurors). When you settle a case, most of the details are kept out of the court documents, and are not public record so your privacy will be kept in tact.

I will only attempt to settle a case if it is in your best interest and ultimately, the decision whether to settle or not belongs to you, the client. I am here to help make the process as easy as possible. Contact me today for a free initial consultation 301-655-8130.

News From Court:

For the past 3 days we have been at the Federal Court in Greenbelt battling for our client, and we successfully reached a "not guilty" verdict!

Our client was a federal government employee who was charged with disclosing personal information about employees of the IRS. By arguing that he had no intention or knowledge of revealing the information we were able to win the case.

If you've been wrongly accused, contact me today at (301) 655-8130.

There are a lot of things to remember when preparing for a deposition. First, it is important to review the case with your client, along with the questions you anticipate will be asked. Practice asking questions to your client, especially the hard ones and follow this advice:

Answer only the question asked. For example, if you are asked if you own a car, answer, “Yes,” not “Yes, I own a Grey 2008 Ford Escape.”

If you do not understand a question, ask for clarification

Do not get upset or otherwise react to the questions. Body language can be very revealing.

Don’t be afraid to say, “I don’t know.” Do not speculate a guess.

Ask to take a break if you need one.

THE MOST CHALLENGING AND PERVASIVE TASK OF THE CRIMINAL DEFENSE ATTORNEY will always be to change the minds of other people. And there are three realities of any juror’s mind that blocks persuasion and make them predictably irrational:

1.Anchor Points: beliefs, experiences, attitudes, or opinions that have left a strong mark.
2. Blind Spots: places in our brain that don’t allow us to see what is actually there.
3. Gut Feelings: the values we regularly rely on.

In order to change minds, we have to know more about where the minds of those folks already are. By understanding these three realities that block any juror’s mind, we are better able to present facts that are able to persuade them.

To read more about these three realities click the link! http://publicdefenders.us/?q=node/128

HOW BODY LANGAGE AFFECTS NEGOTIATIONS

Body language is the unspoken and non-verbal mode of communication. We communicate through smiles, frowns, grimaces, eye contact, poise, and gestures. The value of body language is just as important in business negotiations.

We can connect to people by establishing a sense of rapport by matching body language patterns. By mimicking others, it can create a more comfortable environment for communication. During business negotiations it is important to be aware of your body language so you don’t unknowingly send the wrong signals. By reading and understanding the other person’s signals, you could successfully diffuse stalemates in business negotiations. If you notice tension building by the way they are sitting and avoiding eye contact, initiate a shift in movement to diffuse the tension.

To be a winning negotiator, deploy these techniques in any situation!
