'Pharma Bro' Martin Shkreli has been jailed for his post on Facebook, which offered $5000 "per hair obtained from Hillary Clinton."

Silk Road Creator Ross Ulbricht Loses Life Sentence Appeal | WIRED

Interesting decision today. If you don't remember, Ross Ulbricht was the founder and developer of Silk Road a kind of dark web for drug sales, and more. He went by the moniker The Dread Pirate Roberts and was hunted by groups of government employed hackers. Though it was an open lap top that finally did him in.

He received a life sentence. That was appealed and today's ruling upheld that sentence. What's somewhat amazing, however, is this, from the court's opinion.

“Reasonable people may and do disagree about the social utility of harsh sentences for the distribution of controlled substances, or even of criminal prohibition of their sale and use at all,” the appellate court’s opinion reads. “It is very possible that, at some future point, we will come to regard these policies as tragic mistakes and adopt less punitive and more effective methods of reducing the incidence and costs of drug use.”

“At this point in our history, however, the democratically-elected representatives of the people have opted for a policy of prohibition, backed by severe punishment,”

An appellate court puts the final seal on Ulbricht's life sentence, rejecting arguments about corrupt investigators and the injustice of his harsh sentence.

Maryland judges, commissioners already shifting away from cash bail as reform debate continues

Interesting development in Maryland - a potential fix on something that's been broken for a very long time. Maybe they can learn from the new bail reforms implemented here in New Jersey as of January 1 of this year.

In the months since Maryland's attorney general said the state's cash bail system violates the constitutional rights of the poor, judges and court commissioners have been requiring fewer criminal defendants to put up money for their freedom.

Food for thought. While the US Attorney's Offices often go after appropriate cases, this shows they can certainly also get it wrong, and can use reminder that their role fundamentally is to "seek justice," not seek convictions at any cost.

Howard Root writes that in 2015 Sally Yates signed a memo that makes a potential criminal of every CEO. Time to tear it up.
