Covid-19 checkpoints targeting out-of-state residents draw complaints and legal scrutiny

Little Rhody in the news - and a bit behind the ball, as this was on the local news over 2 weeks ago... and that feels like an eternity these days. We clearly started the trend! (... Of violating the Constitution, or at the very least creating a solid argument that we are. 🤔)

Experts question their constitutionality and effectiveness amid the public health emergency.

Perspective | Freeing inmates won’t thwart the virus if we exclude those locked up for violence

A powerful read - this really solidifies my recent thoughts (and backs it up better than I could!)... It is so easy to just form categories like violent v. nonviolent or "serious crimes" v. "petty" ones, but the actual full picture is truly ever-shifting and full of countless factors to consider.
We need to look harder at options like furlough or intensive probation/parole to deal with this unusual and unexpected pandemic situation; do so with clear minds, and with the end outcome in mind. (Saving lives.)

This population is much bigger, and much less threatening, than we believe.

These prosecutors won office vowing to fight the system. Now, the system is fighting back.

It is refreshing for elected prosecutors to base a campaign on reform (not Tough-on-Crime or other BS policies that do no one any good but cost taxpayers $$$, increase incarceration, reduce alternate services, etc)... and not surprising that there is push back.
Kudos to Suffolk County DA Rachael Rollins and others leading the charge!

Dozens of cities have elected progressive prosecutors recently, prompting a fight over the role of district attorneys in the era of criminal justice reform.

To win a murder conviction, police and prosecutors made up evidence and secretly paid a witness, St. Louis DA finds

While news like this is to be celebrated, the facts and sheer scope of misconduct here is disgusting... Good for the St. Louis DA's Office for setting up a Conviction Integrity Unit (really a Wrongful Conviction Unit or even Police Misconduct Unit would be more accurate..) - it would help quite a few police departments that we regularly deal with. There is NOTHING wrong with accountability in organizations whose main purpose is to serve and protect the citizenry, no matter how late such accountability comes around.

A homicide detective invented witness testimony in four reports. The true killers confessed 17 years ago, and yet still Lamar Johnson languished.

'Fair chance' licensing bill makes it out of Senate committee

The effects of a conviction on a person's future can be far-reaching and can often follow the person for literally the rest of their life - this is a REASONABLE and effective step in the right direction!
If you live in Rhode Island, please CONTACT YOUR LOCAL REPRESENTATIVE and tell them that you are in favor of helping your fellow Rhode Islanders!!!!
(It takes mere minutes to call and say, "My name is_____. I live at ______/in the district of____, and I am asking Representative/Senator_____ to support the Fair Chance Licensing Bill." Or that you appreciate their action/support of the Bill. Or whatever! **Feel free to note that you do not need a call back, as usually the person answering the phones will appreciate that.)

The bill faces more hurdles in the House, where members want to amend the legislation.

ICE breaker: Judge’s ruling bans immigration agents at state courts

What a RELIEF!
The chilling effects that these practices created have been far-reaching.
At least for the time being, the anxiety of worrying about being picked up by ICE is diminished for defendants/clients (as well as their attorneys!) wishing to follow the rules and do the right thing by showing up for court dates.

A federal judge’s order blocking ICE agents from arresting illegal immigrants in or around Massachusetts courthouses sent shock waves through the enforcement ranks.

An activist faced 20 years in prison for helping migrants. But jurors wouldn’t convict him.

More recent great news!
Unbelievable that this man was charged, much less actually went to trial - there are so many layers of discretion built in to the system.... sadly so many cases are still pressed for truly horrendous reasons such as political aims or general deterrence. (Or just no common sense? Probably not though.)

The trial of Scott Daniel Warren, accused of harboring and conspiring to transport undocumented immigrants, ended with a hung jury on Tuesday.

Some U.S. police departments dump body-camera programs amid high costs

It is unbelievable that the cost/benefit analysis does not come out to Body Cameras = worth it. They protect officers AND the public/those being arrested. If officers are acting properly and within ethical bounds, why would you NOT want to be able to prove that with actual footage?!?!

Smaller departments that struggle with the cost of equipment and storage of data are ending or suspending programs aimed at transparency and accountability.

How the Rest of the Country Can Take Florida’s Lead in Embracing Second-Chance Criminal Justice Reform

A welcome reform, and somewhat of a follow-up to the last post. Keep reading, and there is a solid discussion of the economic/employment impact of past convictions. Locally, this is a major issue for many in Rhode Island and Massachusetts, and while RI has made some recent improvements to the expungement/sealing of records (and it is VERY difficult to expunge a record in MA) the effects of a conviction affect many citizens and for much longer than one would think.

States across the country should take inspiration from the remarkable Amendment 4 campaign in Florida.

Almost half of U.S. adults have seen a family member jailed, study shows

Concerning to say the least.
Incarceration is NOT the only answer!! THIS is the outcome from years of politicians being "tough on crime" instead of addressing actual social issues (and injustices!!), not to mention the war on drugs, mandatory minimum sentences, three-strikes-and-you-are-out... the list goes on - NONE of these have been proven to reduce recidivism (ie committing of crimes after release/conviction) and/or make the streets a safer place. /end rant.

The high rate of incarceration in America has an impact on families too, a new report by a justice reform group found.

Also, so-called "anchor babies" (as referenced about 1/3 into the article) aren't able to sponsor relatives until they are 21 years old, so that part of the argument also fails.

If you have any immigration questions, please do not hesitate to call the office, 401-232-8888 and ask for Attorney Savage!

The action, previewed a week before the elections, would be certain to spark a battle over the 14th Amendment.
