Aimee Zundel founded Zundel Law in 2022. Prior to opening her own practice, Aimee was a Partner at Weiss Burkardt Kramer, a leading Pittsburgh education law firm. From 2008 to 2022, Aimee represented WBK's public school district clients. Aimee now uses that experience to benefit her own clients, with the same collaborative, student-centered approach she is known for. Aimee has represented clients at all levels of state and federal court, as well as administrative agencies such as the Pennsylvania Office for Dispute Resolution, Office for Civil Rights and Pennsylvania Human Relations Commission. Aimee has expertly handled special education cases, student discipline matters, employment matters, and Title IX investigations. She also has extensive experience advising on day-to-day school operational matters, school policies, and compliance with new laws affecting educational entities.

Excited to be speaking again for NBI on the important topic of student discipline protections for children with disabilities.

I love this topic. Because at the end of the day, behavior is a child communicating a need. It's a call for the adults in the room to respond thoughtfully to the underlying need instead of simply reacting to it.

Questions this session will address include:
-How do we make sure supports are in place within a child's behavior support plan?
-What behavioral assessments must a school conduct when a student demonstrates behavior that impedes learning?
-What protections do students with IEPs and 504 plans have when it comes to school discipline?
-What dispute resolution options are available to challenge a school's disciplinary actions?

Des Moines, the pivotal student protest case decided by the Supreme Court in the 1960s is still controlling law. Students can exercise free speech rights while respecting school operations by --

(1) Checking school policies and handbooks before planning a protest;
(2) Approaching their parents and/or school administrators with protest plans;
(3) Engaging in protest peacefully - meaning, avoiding threats of harm, obscenity, and interference with the rights of others;
(4) Remembering that schools have legal authority to initiate discipline if orderly school operations are disrupted.
