Juneteenth (6/19/1865) marks the date that plantation owners in Texas were forced to free slaves nearly two years after the emancipation proclomation. The "masters" unlawfully kept slaves for two years without any consequence or repurcussion. Today that same white privilege continues to serve a certain class to the detriment of another, without consequence, without repurcussion, unless of course the injustice is caught on video. This essay is fascinating but not surprising. As the author mentions in this piece, not all cops are bad but they can all certainly do more to break the code of silence. I know folks in law enforcement might deny that there is such a thing but denying it is like denying the existence of racism or white privilege. To pretend it doesn't exist does not make it so.

LA DA Jackie Lacey and LA City Attorney Mike Feuer agree not to prosecute #GeorgeFloydProtesters for violating curfew and failing to disperse. Over 3,000 people were arrested in LA County during the protests. The LA chapter of the National Lawyers Guild (NLG) received an abundance of local attorney volunteers eager to defend all those wrongfully arrested in violation of their first amendment rights to free speach and assembly. In a historic first, the Minneapolis city council today pledged to dismantle their city's police department and replace it with an alternative community based model. While it's unclear what that alternative model will look like, what is clear is that from LA to Minneapolis, #GeorgeFloyd's murder has mobilzed a nation and generated the political will necessary to change a status quo that most of us thought would never change. LA mayor Garcetti last week also announced that he would reduce the city's police budget by $150 million and reallocate those funds to jobs, education and healing for communities of color. We witness the subtle and not so subtle role race plays in arrests, bail, trials, convictions and sentencing. In my experience the work is physically and emotionally exhausting and leaves little time for volunteering or activism. Minneapolis police yesterday killed George Floyd. He was handcuffed, face down on the pavement as pedestrians recorded the encounter, reprimanded the officers and attempted to intervene. The video reflects an inhumane disregard for life that will likely haunt the department and the city of Minneapolis for years. The governor, mayor and rep. Ilhan Omar have all spoke out against the incident and 4 officers involved have since been fired according to the Mayor's tweet. On April 28, 1967, Muhammed Ali appeared for his scheduled induction to the U.S. Armed Forces and refused to step forward when his name was called. He famously said "I ain't got no quarrel with them Viet Cong....Why should they ask me to put on a uniform and go ten thousand miles from home and drop bombs and bullets on brown people in Vietnam while so-called Negro people in Louisville are treated like dogs and denied simple human rights?" While this new law may seem outdated and irrelevent, it is a necessary step in identifying and addressing the long, dark legacy of American terrorism directed at black and immigrant families for over a century. Until we confront and admit to these crimes on a national level, we can not expect to heal the deep wounds that still divide our country.

Cesar Sayoc and others are using the "Trump Defense" to justify their criminal conduct. Divisive, violent rhetoric has consequences as we see here, in El Paso and elsewhere. The First Amendment does not protect speech that incites violence, not even by the president.

Sayoc may be the most high-profile defendant to at least partially blame the president’s rhetoric in a court of law. But he’s unlikely to be the last.

In 2016 Prop 57 made it unlawful to prosecute minors under the age of 16 as adults. The Solano County prosecutor challenged that law and yesterday the court of appeals unanimously denied the challenge and upheld the law.

15 year olds lack the mental capacity of adults and should not be prosecuted as adults and given life sentences. The current law doesn't necessarily let teens off the hook but it does recognize that minors and adults are different and should be treated differently under the law. #JuvenileJustice #Prop57 #ShawkyLaw

Police records released pursuant to SB 1421 reveal misconduct by a South Pasadena police Corporal who fled the scene of a DUI accident. His mother later made a false confession to protect him before the officer admitted fault. This is one of many newly discovered records that remind us that police officers are human. They make mistakes, they make poor decisions when they're scared and they may even lie to cover up those mistakes. This poor decision doesn't make the cop a "criminal" just as our clients are not "criminals" because of a poor decision made during a stressful situation.

Maybe this new law and the associated police misconduct records will result in officers being a little more humble, a little more forgiving and a little more likely to give people a second chance. #Justice #GlassHouses #SB1421 #ShawkyLaw
