Happy Thanksgiving! I’m extra thankful this year for my amazing clients and for almost two years in business!

Just a short video of how I like to make some of my trial binders! (Obviously doesn’t apply to all cases) A trial/hearing is full of so many surprises, so I try to be as organized as possible.
(Yes, I make scripts of all my questions). I don’t always follow them, but it helps to write down the points I want to make with each witness.

This photo caught my eye today. As we enter the new year, let’s reflect on being thankful. Unfortunately, my cases where there is no fighting, but compromise and love are few and far between. So in this line of work, I choose to be thankful and hopefully that will reflect in all my cases going forward. I sincerely wish everyone a happy new year.

New child custody law went into effect yesterday! Joint custody is a rebuttable presumption unless you can prove by clear and convincing evidence it is not warranted.

So when does the protections of Miranda start?
When you are in custody & being interrogated.
A great example is a case better known as the “Christian burial speech”
Offices knew the Defendant was a Christian. The Defendant was accused of killing a young girl but no body had been yet discovered. After invoking Miranda, the officers told the Defendant that the girl’s family wanted a Christian burial. Afterwards, the suspect showed the officers where the body was.
In a 5-4 decision, the Supreme Court held this violated the Defendant’s sixth amendment right.
To invoke Miranda, the Court in 2010 in Berghuis v. Thompkins, required that suspects invoke the right “Unambiguously.”
“Although Miranda suggested that "[if the individual indicates in any manner, at any time prior to or during questioning, that he wishes to remain silent, the interrogation must cease," subsequent cases have required a more explicit invocation of the desire not to speak.”
On this day in 1966, Miranda v. Arizona was decided!
