By 2050, the number of people age 65 and older with Alzheimer’s may grow to a projected 12.7 million, barring the development of medical breakthroughs to prevent or cure Alzheimer’s disease. -Alzheimer's Association
A plan of action is absolutely needed for anyone who has this heartbreaking disease and the sooner in the disease you get started planning the better.

Most of us will eventually need assistance with our daily living and we are lucky to live in a community that has a lot of resources to help. Having the proper Medical and Financial Powers of Attorney in place makes the process of obtaining that help when we need it most a lot smoother. Waiting until circumstances are acute can lead to avoidable disasters.

Here were some suggestions we found from the CDC, HHS, and Mayo Clinic that we put in our own words:
-Mobility exercises
-Brain puzzles, like crosswords
-FRESH AIR!
-Don't forget to drink water
-Eat a well-balanced diet
-Regular Check ups
and lastly...
-Quit scrolling facebook before bed and get some sleep!

Kicking off the peak of hurricane season with September's National Preparedness Month.
It's a good reminder to make sure your estate documents are up-to-date. It is recommended to have them reviewed by an estate planning attorney every 3 years.
However, if you are NEW TO FLORIDA this should happen as soon as possible, as laws differ from state to state.

Although it can be convenient to have your child named on your bank account to pay bills when you’re sick or away, adding a child’s name to a bank account may have unintended consequences for both you and the child.
Issues that can arise:
-The money in your account could be diverted to unintended parties, like an ex-spouse, creditors, or plaintiffs.
-It could disrupt the intentions of your Will.
-Your child could lose eligibility for public funds, and your grandchildren could lose the opportunity for scholarships and financial aid.
-Tax consequences regarding gifting
Always check with your estate planning attorney before adding any person to your bank accounts!

A Living Will, also known as an Advanced Directive or Health Care Directive, is a legal document that spells out which medical treatments you would or would not like to be implemented when you are at the end of life.
Not to be confused with a Last Will and Testament or a Living Trust!
We include Living Wills in all of our Estate Planning Packages.

Today is Juneteenth, the commemoration of the end of slavery in the United States on June 19, 1865. We hope you will join us as we take the day to honor and celebrate this day of liberation.
For anyone who would like to learn more about the history of the holiday and its meaning, the article below from the National Museum of African American History and Culture gives a nice overview:
Juneteenth is an often overlooked event in our nation’s history. On June 19, 1865, Union troops freed enslaved African Americans in Galveston Bay and across Texas some two and a half years after President Abraham Lincoln signed the Emancipation Proclamation.

If you are in need of Medicaid Planning, please please please hire an actual attorney who is experienced in this area of law to do the work. We encounter too many scenarios of folks not getting the proper information from Non-Attorney Planners, resulting in disaster outcomes with no avenue of recourse.

WHEN DO I NEED AN ATTORNEY FOR PROBATE ADMINISTRATION?
Florida law requires an attorney for all Probate Administration. However, not all estates need to go through Probate Administration.
Probate Administration only applies to probate assets.
Some examples of probate assets:
-a bank account in the sole name of a decedent/with no beneficiary
-a life insurance policy, annuity, or IRA payable to a decedent/with no beneficiary
-Real estate that is not homestead (also depends on how it is titled)
Florida Probate Law is robust and the process of Administering an estate is very involved. It also takes time and happens while folks are grieving.
Things to keep in mind:
Choosing an attorney with both experience and understanding of the law is very important. Having a compassionate staff and a streamlined process are also good clues you are in the right place.
