The client contacted us two days after the writ of possession was issued. On any day, the sheriff could be knocking on the door to put their merchandise on the curb. We worked tirelessly through the 4th of July holiday to negotiate a settlement. We reached a settlement to stave off an eviction.

You may ask why so late. Initially, the business owners tried to handle the matter themselves. They withheld rent on a contract dispute. Landlord filed for the eviction and the business owners answered thinking they could get a fair shake and their day in court. However, no one could represent the business, so the eviction was pretty easily obtained.

Well beyond the last hour, we were able to get the job done.

Once the lease expires, the tenancy is month to month. Either party can terminate this tenancy with proper notice.

Also, something to keep in mind, if this tenancy goes on for multiple years, it may become more difficult to locate the original lease. In the event an eviction is required, you want to be able to produce the written agreement between the landlord and the tenant. Without the lease agreement, the tenant can claim a property interest in the property creating an entirely different nightmarish scenario for you.

Best practice: If the relationship is to continue between the landlord and the tenant, then at the end of a lease term, have the tenant sign a new lease or renew the lease. Also, keep the lease in a safe and secure place. As technology advances, it is easier to store important documents today than it was 10 years ago.

If you enter into a leasing agreement, the leasing agreement operates as your contract. Once the leasing agreement ends and you do not vacate the premises, you may be in a peculiar situation, called a holdover tenant. Your contract may state the terms of a holdover, but the contract could be silent.

During a holdover status, either party may terminate the arrangement. This could mean you could be looking for a new place to live within a matter of weeks.
