Mischaracterizing a loss—such as calling wind-driven rain a “flood”—can trigger exclusions and lead to wrongful denials. Most homeowners policies cover “sudden and accidental discharge” from plumbing or HVAC systems but exclude losses from gradual leaks, surface water, groundwater, or wear and tear. Terms like “backup,” “overflow,” and “discharge” have distinct meanings that impact coverage.

Distinguishing between the peril (e.g., a burst pipe) and the resultant damage (e.g., soaked flooring) is critical, as policies may exclude the cause but cover the outcome. Mold is often limited or excluded, yet if caused by a covered water event, related remediation may still be compensable. Courts interpret ambiguities against the insurer and consider the insured’s reasonable expectations.

At 8 a.m. EST this Friday, March 14, the Florida House Banking and Insurance Committee will begin hearings on the report that concluded insurance companies were moving billions of dollars to their MGAs while alleging a profitability crisis to you and your representatives. This report mysteriously failed to surface around the time it was published. We’ll find out who will be testifying later today.

Let’s hope that Floridians get answers that allow us to conclude what happened in 2022, when important consumer rights were stripped from you under allegedly false pretenses.

Commissioner Michael Yaworsky of the Florida Office of Insurance Regulation (OIR), has until November 18 to schedule a briefing with the House of Representatives Committee on Oversight and Accountability regarding the OIR's efforts to protect victims of Hurricanes Helene and Milton from dishonest insurance practices.

I hope this provides a window for more people to understand what is happening within the property insurance industry and how it directly affects their wallets and assets.

Don’t sweat the small firm stuff.

In 2010, I left Orlando for Miami to attend law school at Florida International University. I worked my way through law school at a boutique personal injury and criminal defense law firm. When I graduated, it was with a job at the renowned Miami-Dade Public Defender’s Office, which produces talented lawyers like Roy Black and Jose Baez. That’s where I honed my jury trial skills for five grueling years. My transition from public service to the private sector happened when I co-founded my first law firm with two civil litigators in 2018. Private practice provided me the chance to expand into several areas of civil litigation.

After spending a decade in Miami, it is with tremendous determination that I return to my hometown within Central Florida. Clint & Company aims to establish itself as a leader in our community. We walk the walk on leadership, integrity, empowerment and service.
