The Oklahoma Innocence Project is excited to announce that OKIP client Ricky Dority’s conviction has been overturned. In 2015, Ricky was convicted of first-degree murder in Sequoyah County and was sentenced to life without parole. OKIP took on Ricky’s case in 2021 working with Private Investigator Bobby Staton. Over the past two years, evidence was discovered that undermines the State’s case against Ricky and strengthens the alibi defense he presented at trial. Last week, the trial judge in Sequoyah County determined that Ricky’s right to the effective assistance of counsel was violated by counsel’s failure to find and present a witness whose testimony refuted key testimony from one of the State’s witnesses. In the course of OKIP’s investigation it was also discovered that the State had withheld important information about the same witness and his motives for testifying against Ricky. If that evidence had been presented at trial, the jury likely would have rejected the witness’s testimony and would not have had sufficient evidence on which to convict. The State of Oklahoma has 90 days to decide whether to retry Ricky or dismiss the case. Ricky has served 9 years for a crime he did not commit.

This result is the culmination of years of hard work by OKIP staff, investigator Bobby Staton, several Oklahoma City University School of Law students and University of Central Oklahoma Forensic Science students. We appreciate the work and dedication of everyone who worked on and believed in this case.

GOP Oklahoma lawmakers join call for death penalty pause

We are thrilled that a group of conservative legislative leaders are paying attention to the gross injustices perpetuated by the current setup of our criminal justice system here in Oklahoma. From our years of experience advocating for innocent individuals wrongfully imprisoned, we know that the issues are not just limited to capital cases but extend throughout the system, with many wrongfully convicted persons still languishing in prison for crimes they did not commit.

Pausing ex*****ons out of concern that an innocent person may be executed is a great first step towards ensuring a more just and accurate system. We hope that these leaders do not stop with their call for a death penalty moratorium, but take a serious look at changes within our criminal legal system that will both rectify and help prevent wrongful convictions in capital and non-capital cases. Such changes could include providing a better mechanism for people with believable claims of innocence to get back into court. One way to accomplish that task is to pass legislation that allows prosecutors the power to vacate a conviction of a person they deem factually innocent as has been enacted in Missouri. That legislation recently resulted in the exoneration of Lamar Johnson who was incarcerated for 28 years for a murder he did not commit. Additionally, educating judges, prosecutors and criminal defense lawyers on the causes and hallmarks of a wrongful conviction case, as well as about advances in forensic evidence, would help prevent future wrongful convictions.

As noted in the press conference calling for a moratorium, there have been 10 death row exonerations in Oklahoma. There have also been approximately 76 exonerations in Oklahoma since 1989 in non-capital cases. At this point the question should not be if there are innocent people incarceration in Oklahoma, but how many innocent people are there and how can we best rectify these miscarriages of justice.

With so many ex*****ons scheduled in Oklahoma for the coming years, Stony the Road wants to shed a light on Oklahoma's capital punishment legal process and the path of a capital case/defendant from the time of charging through actual ex*****on. We will discuss the filing of a bill of particulars, the state and federal appellate process after a defendant is sentenced to death (including federal habeas corpus), the clemency process, and the days leading up to an actual ex*****on in Oklahoma.

You will hear from experts in the field and attorneys who have worked on state and federal capital appeals and participated in Oklahoma's capital clemency process, including former Attorney General Drew Edmondson, Professor Andrea Miller, First Assistant Federal Public Defender Emma Rolls, and current Oklahoma County District Attorney Vicki Behenna. The panel discussion will be moderated by Professor Maria Kolar.

We hope you will join us on March 9, 2023 from 11:00 to 1:00 and learn about Oklahoma’s capital punishment legal process.

In the lead up to Wrongful Conviction Day this Sunday, Senators Cornyn (R-TX), Leahy (D-VT), Klobuchar (D-MN), and Tillis (R-NC) introduced the Justice for All Act reauthorization bill! This critical legislation would help to identify, remediate, and prevent wrongful convictions nationwide. I would greatly appreciate it if your organization could please help us thank these bipartisan Senate leaders by posting on social media today and over the weekend, especially as we head toward Wrongful Conviction Day this Sunday. Please see sample tweets at the end of this email!

The legislation, which has been under discussion since last year, includes provisions developed by the Innocence Project and its federal Policy Advisor, Collier Collective. Some key provisions include:

1. Codification of the Wrongful Conviction Review grant program - This long sought after provision would codify the program's current purpose and intended grantees, and would permit Congress to allocate annual funding for the program independently from the Capital Litigation Improvement Grant program (with which Wrongful Conviction Review has shared funding for many years).

2. Authorization of a new CIU grant program - The provision would create a Conviction Integrity Unit (CIU) grant program to fund state and local prosecutors offices to review potential wrongful convictions. The program would give preference to prosecutors that would partner with nonprofits, legal clinics, and public defenders offices.

3. Reauthorization and improvement of the Bloodsworth Post-Conviction DNA Testing Grant Program - The provision would reauthorize the Bloodsworth program at a higher funding level; officially authorize both states and localities as grantees; and create more flexibility regarding the grantee requirement for preservation of biological evidence.

Innocence Project and Collier Collective will work with you and our allies to advocate for passage of Justice for All Act reauthorization by the end of this Congress in December. OKIP Legal Director Andrea Miller will testify tomorrow at a hearing for an interim study requested by Rep. Cindi Munson about Oklahoma’s exoneree compensation statute. In an effort to further limit the role of the Oklahoma Pardon and Parole Board and the Governor in the criminal legal system, the Oklahoma Legislature is considering HB3093 which will prohibit the Pardon and Parole Board from considering actual innocence claims by death sentenced inmates. Oklahoma has never recognized a stand-alone actual innocence claim such that executive clemency may be the only way a death sentenced inmate can have his evidence of actual innocence heard. The State of Oklahoma should have no interest in the continued incarceration of someone that is factually innocent of the crime for which they have been convicted or sentenced.

If you believe that innocent inmates should have at least one forum to present evidence of factual innocence please call your legislators and let your opposition to HB3903 be heard.

To date, the Equal Justice Initiative, which was founded by Bryan Stevenson in Montgomery, Alabama, reports that more than 2,500+ people have been exonerated since 1989. They credit most of the wrongful convictions to faulty forensics, inadequate lawyers, and unreliable eyewitnesses.

I have a relative, been incarcerated since around the age of 19 or 20 for a horrendous crime which resulted in a death. He has been incarcerated at least 30 years. Mike Nolan, to this very date still claims it was a mistake. I would really appreciate if someone from this organization could look into it

My son, Shawn Chase, was wrongly convicted of a crime he did NOT commit! He's been incarcerated 36 years, now, and it seems that everyone is dragging their feet! The OK Innocence Project is allegedly helping him, but he hasn't heard from anyone for over two years! What seems to be the problem? He has even gone so far as to file a commutation on his own, which was denied! The only thing that got him convicted was the testimony of the young men who actually DID the killing, and said that my son was the so-called ring leader! The day of his conviction, one of them actually called me, laughing, saying "he got me back" as I had flushed his w**d stash down the toilet! My son was with his dad and I at the time of the killing, but they would not allow me to testify! This whole ordeal has been a horrific nightmare! Shawn has missed out on his daughter growing up, graduating, marrying, AND having a child! SO MUCH has been taken from him, and us!
We need Attorneys who are willing to go to bat for clients before they are wrongly convicted.
Many of the innocent in Oklahoma prisons, as well as other States, couldn't afford Attorneys.

Oklahoma's Title 21 Chapter 53 Section 1283b. Oklahoma denies second amendment rights without being charged with a crime without any due process only because those who have had a Presidential or state full pardon for crimes listed as violent or the threat of violent's. Oklahoma is the only state with this law. United States' Constitution's !st and 2nd Amendment is not honored for those who have Full Pardons.
