A Will is required by law to go through the court system called probate before any of your assets can be distributed. In fact, a will is only effective within the probate court. ⚖️

While court oversight can be helpful in some situations, the probate process is long and expensive. 🕜 💸 For very small estates the process may take about 6 months, but for most estates, the process can take 12 - 18 months or sometimes even more! 😱 📅

To make sure your family has immediate access to your assets and that they aren’t stuck in court for a year or more, it’s essential to have a plan that includes more than just a Will. 📃 👪 🙂

Did you know? A Will only goes into effect upon your death, so if you’re incapacitated by accident or illness, a Will would do nothing to protect your pet. 🤕 🐶 🐱 This leaves your pet vulnerable to being rehomed to someone you would not have chosen or wanted to care for your pet. FACT: If you die without an estate plan, your loved ones may still need to go through the court probate process to access your assets - even if you’re married.

Surprised? 🤯 😱

Most people assume that if you die or become incapacitated without an estate plan in place, your spouse can take ownership of your property automatically. This is true in some situations, but not all of them. 🤔

If you own property in your own name, inherited property from others, or simply don’t live in a community property state, your spouse will likely find themselves in court to prove their right to inherit your share of the assets. ⚖️ 🤦

Worse yet, the probate process is entirely public, meaning it intrudes on your family’s privacy and alerts other extended family members (and the general public) about what you owned at your death and who’s getting it.
